Can anyone recommend an advocate/lawyer in TRNC who will act for us against our builder who has re-mortgaged the property? We need one who will reply to our emails or is this too much to ask?

Dawn, call Naomi Mehmets office. Number right above your post. I called them 3 times yesterday, phone picked up immediately each time and loads of helpful advice straight away.

Good luck.

I would recommend Dolun Ustuner of Famagusta. She has been an advocate here in TRNC for around 30 years and is excellent. Her husband is 'Elko2' here on the forum who is always full of helpful advice. They are both passionate about the shabby treatment we expats often get from developers here in TRNC. I can't recommend them highly enough.

Her email address is dolun.ustuner@gmail.com - phone number 0392 366 6048.

Although answering e-mails is important, it might be better to look at a litigation/contractual lawyer rather than some of those mentioned who only have a good reputation for conveyancing. Also if your property is in Girne look for someone outside the area because there is too many family, business, friend connections to ensure your advocate has your interests at heart.

Good luck

People are recommending lawyers because they get emails returned? It would help if we knew who the builder was as many lawyers here work for the developer as well as the purchaser as it's not illegal here, but IMHO it's highly immoral.

Naomi Mehmet is a conveyancing lawyer and has little or no litigation experience. As Bradus states, it's probably best to choose someone out of town.

I agree with Rhodesian with regards to Dolun Ustuner . She's the only lawyer in TRNC that is feared by Ismet! If anyone was stupid enough to sue Ismet, this would be the lawyer to use!

We are using Dolun in our litigation against Seaterra. She only covers Famagusta though.

agree with JimmyG msg 5.

Mine Konat always answers my emails and has done for over a year, if she says she will call you she does and at the arranged time.

She also informed me about the Pre 74 Turkish title problems LAST YEAR when the estate agents were fertively pushing these properties so she is also good at acting on YOUR behalf.

TheSaints, like I said, many lawyers are working for both the buyer and developer!

If in doubt, for free and experienced info speak to the HBPG for the latest details.

Sener Law firm only answer emails to tell you what they want you to know (whether it is acurate or not). When you ask specific questions and want specific answers you do not get a reply or as I found out, you ask 6 questions and get half an answer to 1 question. I have loads of non-answers on my system

Ref. msg.14

It is true that she does not take on cases outside Famagusta Court but please bear in mind that Tatlisu comes under the jurisdiction of Famagusta Court.

"Like I Said" Mine Konat works on your behalf when she advised us of the future problem of purchasing pre74 which over a year ago, was true as we have seen recently she also advised me if we had considered renting prior to considering a purchase. Prey tell how is that working for the developer?

Msg 13, "People are recommending lawyers because they get emails returned? It would help if we knew who the builder was as many lawyers here work for the developer as well as the purchaser as it's not illegal here, but IMHO it's highly immoral."

The original poster was asking for a lawyer that returns emails which is what people have responded to.

Try Gunesh Mentesh!!! Its enough to turn you to drink he is my advocate, i have a problem with the developer i.e. nothing is being built i want my advocate to sue the b**tard and give me some answers. They wont act on my behalf as they are involved with the developer conflict of interest and all that. Lesson learnt i guess but a bitter pill to swallow dont now what to do next??????

THE SAINTS,

At long last an advocate who is being truthful regarding the problems with pre 74 Turkish Title. My I ask what advice was given and if there was a reason given for not purchasing this particular deed?

Hi Bradus

Mine Konat informed me last December that there was going to be a problem with pre 74 title in that she had received a memo from the council of ministers that she should not submit any PTP applications from Foreign purchasers for pre74 title property as the PTP would be refused she also stated that this memo was sent to all advocates at the same time and she did not charge me anything for this information.

Gurkan and Gurkan I would not recommend to anyone ,they never respond to emails , but are very interested in taking your money and never update you as the laws change.

msg. 26:

"... this memo was sent to all advocates at the same time and she did not charge me anything for this information. "

This is not true. If such a memo was sent to all the advocates or even a small percentage, it would have been common knowledge by now. Indeed I suspect that the Council of Ministers are now more reluctant to give PTP on pre74 to foreigners but they hide behind the "army" as an excuse.

As to which advocates worked as "hand in glove" with some developers, the hbpg should have a very good idea. Some did it quite openly and some more discreetly. Anyway, now its too late for most but it makes my blood boil to observe how blind some expats can be.

Hi Ismet

I am only stating what she told me last Dec when I asked her advice on a pre74 title property we were considering purchasing, I was informed that the memo was sent to all advocates at the same time.

Maybe she received the information and presumed others had.

I have no reason not to believe her as the information has proved good and on the other hand I have no reason to doubt what you say as you are in the know.

So let's just say Mine Konat gave me sound advice, as you do from time to time.

After attending many of the HBPG meetings, talking to lots of people who have been through problems and showing my support when people were having their homes auctioned beaneath them, you get to know snippets of valuable information and in my opinion Mine Konat was one of the lawyers who was working for both developer and customer.

Mike, glad you got some good advice, many people don't here.

As far too many people have lost their entire life savings, I would recomend that people get advice from HBPG.

Mess 28 - "Anyway, now its too late for most but it makes my blood boil to observe how blind some expats can be.". thankyou Ismet, that is a wonderful example of the TC attitude. "I know I ran into your stationary car, but it is all your fault." And that just about sums up the TRNC and it's peoples' attitude for me!

kaiserphil, I think it is an unfair twist to what I wrote. I was clearly referring to people who refuse to see the facts even today.
