Hi, I don't have a copy of the CT but read the headlines that the court in Girne ruled in favour of an english couple in Alsancak that the villa was illegally built, the land has not been parcelised and there are no planning permissions. Imperial construction has to pay £205,000 and also give them 2 apartments in lieu of costs. Oh, and Imperial reckons he can sell this villa for £500,000 when the market picks up as it is the best villa he has built! Sorry can't be of much more help.

You of all people, you know very well that your villa at Ivy Gardens Karsiyaka has all the necesary planing permisians, a copy of which was given both to your agents and lawyers at the time of sale.

If however you wish to make further surches this are the referances you need.

B598/4 for the Kaymakam & 1623/05 for the state planing office.

Court Sides With Expats.

I have a lot to say about this case, I am due to meet the publishers on Monday, to request that they set the record right, therefore untill than I will only say this:



There were no hearing in open court therefore there can be no ruling by the Judge, by the way the judge was not Huseyin Besimoglu (one would expect Cyprus Today to get the Judges name right!). The Judge was the Girne district court president Turker.



There were a settlement outside court, and what we have agreed between us, our respected lawyers saw the Judge in his chambers and wrote as settlement as record.



In brief the Taylor's bougt from us:

One Villa 268sq meter + 110 sq meter basement as garage etc + 5X10 pool with BBQ Bar etc etc. seating on one donum land.

Two bungalows each seating on one donum land, 130sq meter doble garage + 4X8 pool.

Three 2 bed 75 sq meter flats.



They have started making stage payments and in total they have paid £315000

They took possession of the villa on 26 th August 2004. They was waiting to sell Mrs. Taylor's house from a former marrage. (She was previosly married to Mr. Taylor's best friend).

They was due to pay me the balance of the monies £207,000 on the 28th February, they fail to pay. The litigation started on 6 th April 2005.



I have agreed to take the villa back and keep the 2 bungalows and one of the flats, and give them their money back.



The payment would be made by given them 2 flats at a value of £55,000 each (original value was £30,000). Total £110,000.



The balance of the money £205,000 will be paid to them in 18 months.



Cyprus Today, said "Court sides with expats" After reading the tru story what would you say?

Good luck BB. I know of people who have bought through you and they are all very happy. Cyprus Today does have a habit of being complete Doom mongers (almost as much as some of the people on this forum - I wait the backlash for that one) and like all press they are prone to exageration. They do say that bad news sells papers so I wouldn't expect anything positive in there any time soon!!

I bought a property from Gultekin Ben in Karsiyaka approximately 5 years ago and have nothing but good words for him and his company.



My house was built to a good standard and on-time and any snagging was dealt with promptly and efficiently. Communications between us have always been attended to quickly, often by return email.



Currently I have a problem with slight subsidence on my pool terrace and it is being recitifed by Mr. Ben at no cost to me, despite the property being completed a number of years ago.



In running my own business in the UK I have met many dubious characters over the years making me a good judge of character, and I'm confident that Mr. Ben is not one of them. From my experience his is a gentleman and a man of his word.



I do hope my words will give some comfort to people currently having properties built by Imperial. I know there are many satisfied customers who he has built for and indeed I bought from Imperial on personal recommendation.

Agreed with Message 14 above. We bought many years ago directly from Mr Ben and have had no problems. Have recommended to friends who have bought too, and they too are happy.



Like with most things, there are probably 100s satisfied customers and 1 unsatisfied. The silent majority make no noise, but the 1 unsatisfied makes an interesting article for the press...



In the UK, Barratts & Wimpey build 10,000s homes a year, all meeting Building Regulations and with NHBC Guarantee to sort things out. But still "Homes from Hell" are able to find a few unsatisfied buyers and make a program.

I agree with all that you say about him but the disatified customers with reference to para 3 are the ones where the builders do nothing to put things right.

Again I agree mostly with your comments except to say I have some issues with our property. Not major issues but some outstanding work needs inspection and attending to.

I have 1 of 10 properties near Mr. Ben's new development at Karsiyaka. They were not built by Mr. Ben. For 4 years we have been without a road - the fault of the Kaymakam, not our builder.



Aware of our problem, Mr. Ben has arranged for an access road to us from his new development when it is finished. He owed us nothing, he just wanted to help us - what a great guy he is.

Don't believe all you read in newspapers. Even superstars tell you this!! They will only print what they feel is necessary. They forget to include the truth at the best of times.



We bought from Imperial almost 6 years ago and we have received fantastic service from Gultekin and he has done a lot for us (without charge). I know I can call on him at any time and he is always willing to help. Of course he is a businessman but all businesses need to be paid for work that has been carried out. We paid monthly installments, in advance. This was our arrangement and we never defaulted. We were informed regularly on our build and we received regular photographs. In all, we got what was expected - on time. His integrity is undoubted.



I would like to thank Gultekin Ben publicly for all the help and advice given and I wish him well.
