Has anybody out there had the misfortune of buying a property off plan through NCP (North Cyprus Properties) and are now struggling to get their money back as NCP appear to be no longer trading?

My wife and I purchased an off plan villa which was due for completion in November 2006, but it still hasnt been completed

We were promised a complete refund from the company director but this was never forthcoming.

We are now pursuing a refund through our solicitor but this is looking like a fruitless exercise

Is anybody else in the same situation through NCP. If so what are you doing to remedy the situation?

I would be grateful if anybody else has some advice

We are sure that this company no longer exists and they re-invented themselves as someone else

Can anyone else remember this happening and it being reported in earlier postings ?

NCP merged with Lider Construction (Mainland Turkish company) and formed new company called 'Mainland' or Anayurt (Turkish). Details of this are on the forum. Go to Serenity Appartments on 'Top 44 Properties' page and check the thread on the same topic. Don't know whether this is of help.

Good luck - sad to hear about your loss.

I have tries contacting mainland but have had no replies to emails or telephone calls so far

My solicitor has been away for a couple of weeks so I will follow up with him tomorrow

And some people wonder why there is a complete lack of faith in the TRNC legal system and the government that has allowed this shameful injustice to happen. Just how will cases such as this help the TRNC economy?

What I remember is that North Cyprus Properties got took over by Mainland and I think they went bust. They had two sites in Esentepe one on beachside and other up towards Lapis developments. London Cyprus Homes took one of the sites over and is now called The Lanterns. They may be able to help you never know. North Cyprus Properties and North Cyprus International are 2 different companies.

If someone buys one (or more) of these properties being sold by the bank, then I would have thought that the new buyer would also be found by the courts to be fixed with constructive notice of the original buyers interest. Thus the original buyer having paid the builder in full and taken posession would have lawful possession of the property. The bank with it's mortgage would come a miserable second (in fact have no claim on the property at all) and the new buyer would basically only be buying the debt off the bank. Not a gamble I'd be willing to take.

My friend bought in Olive Grove so I know a bit about it.

NCP were one of the top building firms in TRNC, they got caught out when the market dived. Yes they made mistakes.

However, according to NCP, the KOOP (Central Cooperative bank) loaned them money secured on houses the bank KNEW were sold. They even took copies of the contracts.

Worse, according NCP, they bank turned down more valuable assets as security since they believed the builder would be less likely to default on the loan knowing it would hurt so many customers.

This being the case, the bank is the reall villian here - totally immoral. So is the bank trying to sort things out with the contractural owners? No, it has applied to have the properties auctioned and the people evicted from the homes they bought and are living in.

Shame on the KOOP bank BUT, the people are now starting to fight back and their website

http://www.esentepeolivegrove.com

comes top when you seach for KOOP BANK TRNC.
