We are now getting demands from our builder for our final stage payment. He is threatening us as we have clearly told him that until we can travel to the TRNC at the beginning of April to register our contract we are not going to pay him any further money. Our main argument being that until the documnet is registered we are not 100% sure he hasn't taken a mortgage out on our property/land, it is our understanding that this could be a remote possibility. Has anyone else had the same problem. The other concern is that until we have actually seen our house and made sure everything is completed we are not prepared to rely on some photos sent to us by said builder. We would appreciate hearing from others about their experiences.

Whilst I have not been in your position (I bought a completed apartment), all that I have read on these forums and my knowledge of UK law (which allegedly TRNC is based on) tells me that you are absolutely right. Not that I have any faith in TRNC lawyers but are you using one?

Dont hand any monies over until you are 100% happy with your purchase.I dont like the way you are saying the builder is demanding the money.When was the last time you physically saw the property.How do you know that it is actually finished.Where have you bought just as a matter of interest,

oh do be careful , i would echo paul's advice , it does'nt sound very pleasant for you , but do not hand over any more money at any cost , until you are 100% sure , there are some really good l awyers out there , i hope you are using one of them , if not just ask and we can recommend one for you , infact there is a thread with a list of reputable lawyers .

Do you know anyone who is already out there that can go and look at what stage your property is in. Have you bought through an estate agent as although I have no faith in them they should be able to tell you the position.

I think its outrageous, you certainly should,nt part with final payment until you,ve had a chance inspect it personally. I ve never heard of any other builder demanding such. Your solicitor should formally tell them back off.

Just for your peace of mind I,m sure other members of this forum would take a look and give an impression to state of play if they knew where it is.

I will be going to TRNC at the end of March. Do I have to pay the stamp duty before registering my contract and does it have to be translated into Turkish?

Yes david you pay stamp duty at the Tax Office first .

Famagusta will only accept contracts in Turkish, Kyrenia seems ok at the moment for english but things could change tomorrow.....???

Do not pay your final payment until you have taken advice.



Marion at HPGB is perhaps the most sane, well connected person involved in this whole bloody nightmare. SHE DESERVES MEDALS FOR WHAT SHE HAS DONE FOR PROPERTY BUYERS IN THE TRNC. Be guided by her advice!

Dear lippylush - Regarding parting with money before you inspect your property - honestly it is the builders fault you cant get out to N. Cyprus until April? Why should he wait for his money? His kept his end of the bargain you should keep yours. You have enough volunteers on this forum who will pop along and take pictures for you - an unbiased volunteer! As for your concerns about lodging contracts get your lawyer to do it. So what if they are charging between £200 & £350 for this service. Its a small price to pay for piece of mind. Your builder will now have to suffer because the build completion does not fit in with your travel plans?????? Think about it and tell me where else in the world you would be able to get away without paying the balance of your money when building is complete.

Thanks for the information. Isn't there going to be a sort of amnesty on stamp duty or do I pay the 1.5%. My contract was drawn up in September 2005.

where i can see where you are coming from , surely there should be some degree of good will and trust between the builder and the buyer , lippylush has paid the majority of the monies so the builder knows he's good for it . people can't always have time off from work just when they want it . and i don't think personally you should the pay the remaining money without seeing the finished product , for gods sake its only a few weeks he has to wait and if he is being aggressive it just makes you wonder why , stick to your guns lippylush

it is interesting to note that you only became a member on the 15th of this month and that you are Turkish Cypriot, based in Kyrenia, one wonders whether there is a connection between you and a certain builder who we are dealing with. Gven your comments I wish to make it known that all our stage payments have been made either on time or before they were due. We are currently still waiting for our pool to be finished, there is still no pumps etc in place and I'm sure Wynyardman knows exactly how we feel as he is experiencing similar problems.The reason we are being given being that until electricity is in place there is no need to finish this particular job, from the looks of some of the pictures we have recieved there are problems with the finished work and as we have had to make emergency plans to travel to TRNC to sort out both the contracts, electricity and check our house, 6 weeks does not seem extreme. If the builder who is currently in finanial difficulties is threatening us then so be it, we will not be threatened there is much more I could say about this builder and past threats which I would not dream of saying on this site. April 2nd we are flying over and if everything is sorted then we will pay outstanding money owed. Thankyou to all the posts which have offered support with regard to our dilema/concerns.

Dear Sue and Dave I can assure you there is no connection between me and your builder. On your first posting you did not make yourself very clear - you simply stated that your builder was demanding his money but you were refusing to pay until you could lodge your contracts at the DLO. Had you been as clear as your 37th Posting then my message to you would have been different. Didnt mean to offend.

Its a good bet that this (as with most other) builders that this property was not completed on time which would probably throw travel plans into chaos for final inspection.

I think most brits would gladly keep thier end of the bargain if only the builders kept thiers ?

if the builder has finished surely he is entitled to is money ,And it must be up to you to check the property as soon as possible ,have you not not heard about cash flows and overdrafts. the guy has got to pay his workers so they can feed there families come on play fair

Lippylush - how about you appoint an agent to go out and have a look at your property. Get them to do you a full report. I think until you get a full report/photos you cannot really make any decisions. If the report shows unsatisfactory work and its not finished you can then go back to your builder with the report/any photos and get him to complete these things before you send the money.



We never inspected our property when the final payment was due. We had someone go and look at it for us. He also did our snagging.

I would go out there, I don't know what you paid for the place but for instance if it cost £50,000 at this moment in your life what is more important than dealing with this.
