We have a non-payer of maintenance in our complex. As everyone can appreciate, if one owner does not pay maintenance then it places an unfair burden on those who do pay.

The culprit is a Turkish Cypriot from London. Is it possible to use the TRNC courts without spending a fortune on lawyers? or does anyone have a good idea that may work?

I'm sure there was something about this last year. Anyone remember?

Hi awellwisher,

Can I ask how you get your water? On our complex we have to pay in advance for it and if you don't pay your service charge, you are refused water. Some owners have said it is against their human rights to be refused water but it does seem to be effective.

Hello Butlers Wife.

Thanks for your interest. We obtain our water from the mains supply which fills up our own individual storage tanks.

Hi awellwisher,

I doubt then there is little you can do about this situation, if the non payer is a turkish cypriot they know they will not be prosecuted in the courts and made to pay. Most complexes have this problem and unfortunately it is the rest of the owners mainly brits who have to carry them.

Well I'm going to surprie many of you. There is a court and legal system here. You can take a TC to court for non payment of maintenance. You can do it yourself or get a solicitor to do it and claim costs. I do know of a TC who wa taken to court for exacly this problem and she lost in court and yes - she had to pay.
