As adviced by my solicitor (Sener Law Firm) I can use a notary rather than the TRNC Consulate to witness POA form. After ringing a few local ones I have had a quote for £50. Just wondered if any one has done this? If not why not, as it seems a good alternative than travelling to London on a week day. I would persume the notary does not have to speak Turkish as POA is also in English. Any advice on this would be greatly appreciated.

According to the HBPG (and PM's question & answers webpage) your lawyer does not need a POA to pay the tax or register your contract.

Why lawyers are still going down this POA route is a mystery.

jumbo - we got a quote for a Notary to witness our signatures to our POA (which is in English) and he wanted £50 as well. Someone else got a quote for £75. Once it is witnessed by a Notary you then need to post it to the Consulate for them to stamp it £12 per name. They will then return it to you and you then send it on to whoever you are giving Power of Attorney too.



With regards to the HBPG news that we dont need POA's drawn up - I'm not sure about this - they are probably right but I am just being safe because I want to pay our stamp duty

When you first went to your solicitor who is the same as ours, did you give her poa then to go ahead with your sale, if so that will do to register your contract, she states this in the email we received when she notified us that it would cost £350.00 for her to register for us. Before going to all the trouble of going to London etc, try emailing her to confirm that this is still the case. it could save you time and money.

The second website above is from the TRNC PM re paying the tax:



2. Buyers pay the stamp duty but who is responsible for paying it to the Tax Office?



Payment of the stamp duty is a liability of buyers.



This process can be done in person at the Tax Office in your district.



" Anyone other than the buyer, estate agency, the builder or the lawyer, required to have a power of attorney authorizing to carry out this process.



The original sales agreement and a copy of the sales agreement are the compulsory documents must be produced at the tax office. "

Lozzie we didnt give her Power of Attorney at the outset so we do have to draw one up in favour of someone else. Thanks anyway. I might go and do some retail therapy while I'm in London!!!

I am also using Sener Law Firm. Our Notary's stamp and witness of signatures was £65. The POA was posted to the consulate with postal order and SAE and was back within 4 working days.

Has anyone used a notary in Ireland to witness the poa and forwarded it to the Turkish Embassy in Dublin for stamping? Will they accept it done this way? Or do we have to go personally with the poa?

Many phone calls later I can now answer my own question! So this might be of interest to other Irish buyers in North Cyprus.

You can use a notary to witness your signature on the poa form. You can then post the stamped form to the Dept. of Foreign affairs, Consular Section, in either Dublin or Cork enclosing 20 euro per page sent. (Registered Envelope recommended) They will put the official Apostille stamp on it and send it back to you. No need to go to the Turkish Embassy
