Hi

I have had my stamp duty paid but the solicitor told me he could not register because he has no notary power of attorney , the power of attorney used for signing my contract at the time is no good for this proccess , he told me to go to TRNC consulate in London , presently im overseas working so unable to get to the consulate, is there alternative solution to getting this done , ie walk into to an independant solicitor?

Robbie,

I overlooked one factor. If you are currently in a country which does not have a TRNC Representative, just get the POA certified by a local Notary and send it to your Advocate with a note that there is no TRNC Representation in that country. If there is then you send your papers there for certification.

The underlying principle here is that the TRNC REpresentative is supposed to have a list of Notaries in that country and be able to certify their signatures. Hence it is no good to get your POA certified by a Notary say in Qatar and then send to London Consulate for certification.

Thanx for the info , im actually in Perth Western Australia and i believe there is an office in the eastern states , so i would fill out the POA and a copy of my passport then send to the office, do they send it back to me , also when i sign does somebody have to witness my signature or do i just sign it and send it to the office they return it back to me after and i send it to the solicitor in Cyprus.

Robbie,

1. Get your Advocate to send you a written POA and you jut print it out.

2. You should sign it infront of a Notary and they will certify that it was signed by you. They know what to do.

3. Telephone the TRNC Rep. and ask them their postal address and how much to send them and how. Normally they accept postal cheques but not personal cheques.

4. Send them the POA, a photocopy of your passport (the page with your picture on), the fee and a stamped addressed envelope for the return.

5. Then send it to your advocate with the photocopy of your passport.

6. Keep your fingers crossed until you hear the result and hopefully no mortgage on it.
