I receaved my deeds ca 3 years back without a will !!!!

I heard that there is a new law in Cyprus about having to make up some new rule every day and start a rumour.

Hi everyone, I believe that if you die and do not have a will in place regarding your turkish property it doesnt go into your estate in England, but is then held or rather 'given' back to the government in N.C. This could also be a rumour but we have a 'turkish will' just so it stays in the family etc. But then again I dont intend to 'kick the bucket' yet.!!!! Still got loads to do.

Best to have a NC will which you then deposit at the court. That way no arguments hopefully and your property goes to whom you want. Make sure you put the correct copy of your will in the envelope for court, unlike a certain well known lady lawyer who put the wrong one in. Only discovered when the will was opened when the person died and the widow was trying to sort out the estate.

Will or no will, it does not go to the government.

Such a mistake should never happen but I suppose we are all humans and a mixup can happen. I am sure this lady lawyer will do everything possible to sort it out for no charge.

Hi elko2, ---- is that for sure that the property doesnt get put into 'limbo'?

We were told that it does and its one hell of a job for the next of kin to sort out, and prove that it belongs to the deceased estate. Be good if its so,

Yep you are so right Hector, we made one and it didnt cost much, I think about a £100 or there abouts.

It is advisable to make a will. If there is no will, the estate will be distributed in the same way as Turkish Cypriots i.e the remaining spouse gets one sixth and the rest shared equally by children. If no children, the brothers, sisters and parents of deceased are all eligible heirs. Proof of each heir is another matter. So you make a will unless you want to punish the remaining ones in some way



However it is not true that unless there is a will it goes to the government. It may end up in limbo but that is not the same thing.

Hi

you can set up a will your self. You can also get a templet from HBPG. Send an e mail to Marian Stokes and she will send you the templet

When you go to court, to sign, (Monday, Wed., Fr.) you will need 2 witnesses, remember your passports, and stamps; 38 TL.(postoffice)

Your will is put in an envelope, with a number, and sealed. You get a receipt with the number, that you can place somewhere (with a copy of the will)

I am adamant that the joint account owner can withdraw all the money when the joint owner dies but the tax office think differently. They argue that half of the account is subject to the estate of the deceased.



Cooperative Central Bank which is effectively controlled by the government accept this view but most banks do not. It has not been tested in the High Court.
