You sell your house to a turkish cypriot for x amount. You do a good deal because you feel sorry for her, you ask for a deposit, then a certain amount every month for 12 months and at the end you pay the remainder minus the sum of the monthly payments and the house is yours. Now thats what the contract said. She paid the deposit and various sums for two years then stopped paying. About two years ago she abandened the house, gave away all the furniture that was sold with the house owing 2000 lira electricity and and a lot to the belediye. The house has been empty for two years, going to ruin ,neglected, the pool dried out etc etc. The owner decides that he cant let the house go to rack and ruin ,so he enters the house, cleans it and was ready to lock up and go when the police arrive and charge him with breaking and entering. She is living abroad now but her sister complained to the police. Is this justice?

The proper way to do it is to go to court and get an order. Otherwise you are trespassing. As simple as that. I know of many students who leave without giving back the key and the landlord risk arrest if he enters without a court order. To make it worse the tenant who is not living there any longer may claim that the landlord has stolen his goods. So you must consult a lawyer before entering otherwise you are in danger. ismet

Bit late to say ,but before anyone does anything to do with property in NC,be it renting or otherwise, think of the worst case scenario, presume it will happen and assume you are on your own as regards legal recourse. Do that and things can only get better.

He did go to court but it dragged for so long and also they wanted a large deposit because he was a foreigner. In the end when he found out that the house was deserted he thought it was abandoned, so he went in. Now he has to go to court in the morning with a criminal charge. she is the one broke the terms of contract and yet he ends up in court.

This thing happened to someone I know but he played it very cleverly. He broke into the house claiming that there was a flood and it was an emergency. He went in after with a muktar and they made a note of everything that was inside and then changed the locks. He did end up at the police station after but was not charged with anything. The tenant lied that she had gold and other valuables stolen but she got caught out. He did eventually get the tenant out but had to pay 2000tl for electric.

Same thing happened at the Treasure restaurant. The tenants. owing much rent, did a runner back to Turkey having smashed everything inside. Owner went back in only to be arrested because tenants lawyer complained. Tenants never returned and court case dropped I believe. Great system eh?

would it be different in UK I think it would because inventory deposits etc but bad tennants are what thet are. In UK you usually use an agency and the are checked out for criminal records CCJs etc and bonds are taken so I guess maybe slightly different but as i said good and bad everywhere xx
