and are they conducted in Turkish only ?

1. The courts in TRNC are open to the general public provided you are dressed properly i.e. they do not allow men with short trousers. Only a few weeks ago the policeman at the main entrance of Famagusta District Court tried to stop me entering because I was wearing short trousers. He had no chance but let me in and I gave him a lecture about the matter. Only the court rooms where a hearing is conducted is out of bounds for short trousers.



2. In some case like a sexual attack on minors can be heard in privacy i.e. only the lawyers are allowed into the court room. However even a divorce case with lots of sordid evidence, secret cameras and so on are heard in the open.



3. Those who do not behave can be thrown out and in serious breaches even arrested for contempt of court and kept detained at the pleasure of the judge.



4. Soldiers and even civilians who tresspass an out of bounds area are tried in a military court but the judges are from the normal civil courts in rotation, assis

5. Courts in TRNC are by and large independent of any influence or bribery. So influential people in civil or public life can hardly influence a decision. However the judges sit on all sorts of cases, civil, commercial, criminal, admiralty, matrimonial and so on, so they have no chance of specialising in anything. The same goes for the advocates. This msut be a common problem with all smaller countries.

Oh, I have overlooked the language. All trials are conducted in Turkish. However official interpreters are provided by the court free of charge including civil cases. In civil cases it is up to the advocates involved to arrange for the official interpreter. In a recent case my wife as an advocate could not arrange for the official interpreter because her services were required in another court that day. She obtained permission from the court and arranged for the retired offical interpreter to attend rather than have the case postponed but her client had to pay for his services. He charged only 100 TL for the day, very reasonable. In fact now this client is using his services for their regular translation needs.

Hi Elko

As you seem to be knowledgable on legal matters ,I have a question for you .

You might be able to give me an answer.

I have the deeds of a land in Dikmen and have had it for 17 years. This was given to me as eşdeger for the land we left in the south. There was a very old barn type building on this land. When I came to view the land an old couple had fixed the barn and made it livable and they were living in it. As I was living in UK before I let them live in it. But now I live in Cyprus and want to make use of this land.



The old man has now died and the lady is quite old but still alive and lives in it. What do you think is the best procedure to follow in order to be able to gain control of the land again.

Your views are appreciated.

I presume that you spoke to her and she does not intend to move or she does not really have the means to do so. This is a social matter and can be handled in various ways but I think your question was purely a legal one.



You or your advocate should send her a notice telling her that you have the title deeds and would like her to vacate the premises within a month or so. After that you sue her for tresspass. The court has no choice but order her to vacate the place.It can take you a year or so to go through all the steps but it can be done.

Don't skip read, if you can read at all! 'Biker' inherited the land 17 years ago and realised then, there was a squatting couple on his land but left it without taking action as he was UK bound. On his recent return he wants the land back so, what to do?. The woman is old, kick her into the street? Rent a flat for her? Poison her? Take legal action which will take 2 years+, money and then she'll be dead! I didn't read she was Greek as much as I didn't read that you were human!

Thanks a lot for the information you supplied.

Yes, I think it is about time for her to find somewhere else to live. 17 years without paying anything is a good enough favour in anyone's book.

I will have to find a decent solicitor who is not going to mug me to handle this.

Any suggestions? Do you know anyone in this field that does not charge the earth?

I am very weary of recommending any advocate except my wife but she does not take on work from outside Famagusta court jurisdiction. I suggest you find one in Nicosia. If you have a few in mind, let me know privately and I will choose the lesser evil for you

The IPC is a "Commission" and not a court. I think their deliberations are in private but I am only guessing.
