Can anybody tell me what the truth is please...... one source tells me that my UK will is OK here and another tells me that I must make a new one in Turkish. What exactly is the truth?

Bill in msg 2 is right. Your UK will (or any other EU country) will not cover your assets when you die (my lawyer told me only days ago).

Lawyers in TRNC charge you between 75 and 150 Sterling per will (in Turkish with an English translation), which then has to be registered (in my case: Girne court). And I wonder why we have to pay so much money for one (most of the times: standard) A4 from a computer! When you copy an existing English will, fill in your own details and have it translated by a Turkish speaking person the result will be the same. But much, much cheaper. (Or am I wrong, Ismet?).

Another Advocate scam as it has to pass through them before it's recognised, for a huge TL consideration, of course! How this stacks up in international law has yet to be tested.

I was told you can go to an Advocate and its costs you £50 they then register it with the courts, ny neighbours did this and its in English/Turkish so why do Solicitors charge double or even more.

What happened with writing out your own will and getting two people as witnesses. then a taking it to the court for their stamp

Contact Marian Stokes at the HBPG. I did to ask her what to do about making a will here in the TRNC she sent me an electric copy of a will and told me what to do. You just complete the form, take 2 witnesses with you down to the courts along with all passports and you can lodge your will with them and all it costs you is there charges and it is legal. I can send you a copy of the form and the instructions as well if you email me on travelbugs22@aol.co.uk

Oh please, if you don't mind, could you email me a copy as well. I have been looking at several but couldn't find one that was suitable. If you own property in the TRNC, it is a legal requirement to have a will here.

Here we go again.

1. You can have your will in Turkish, English, German, Russian, Mandarin etc. but you may have problem in proving it when it is needed to act on.

2. It is better to lodge it with the court but not essential. The court will not look at your will and therefore will not check it if it is valid or not. They ask you to put it in an envelope and they put that into their own envelope and seal it and check the idendity of the testator.

3. Wills are subject to certain formal rules and fatal if not adhered to.

4. There are rules about disposable parts and undisposable parts and these rules differ for a)Cypriots, b)British and c) other foreigners.

5.You can have your will drawn up in Tin baktu tu if you like and it is valid but you may have problems in proving it. It has to be stamped properly and I am not sure what happens if it is not. If the stamps are missing, does it make it invalid or do you simply pay the penalty? I am not sure on that one.

In short have one drawn up here with the right stamp and the right eligibe witnesses.

My father died with an English will. My mother had to go to London to have it re certified as a proper will and testament by a British Solicitor, had to have Probate granted in the UK, had to have the TRNC authorities in London accept and stamp it, BUT probate was still not granted in Cyprus as the will was contested.



For your Cypriot movable and immovable assets HAVE A PROPER WILL WRITTEN HERE.



No doubt you will get ripped off but shop around a bit and get some quotes, and settle for the smallest rip off.



Failing that if Marion Stokes can supply you with the PROPER paperwork use that instead. How will you know it's the proper paperwork? Take it to an Advocate?????

I am being inundated now for this form but will send it out to everyone that asks. Instructions copied from http://www.hbpg-trnc.net/documents/Will.html (Will starts with capital letter okay). See below:



Hope this helps.





It is imperative that you have a TRNC Will lodged with the Courts. We can supply you with a basic Will template in English which you can do yourself.



You need original Will, 38 lira (32 for Will and 6 for Register) Post Office revenue stamps brown A5 envelope. You must go to local Court office with your passport, two wittnesses with their passports and sign the Will document in front of clerk. The details are recorded in register, Will is stamped put in sealed envelope and you are issued with official receipt.



The Court office is now only accepting Will registrations on Mondays, Wednesdays and Fridays.



If your lawyer has already prepared a Will for you please ask them for the Court receipt

Had my will drawn up by a notary in the TRNC, it has the official stamps and witness signatures. do I still have to register this with the Court Office? If so which office in the courts building do I do this?

People who have assets both in Northern Cyprus and the UK or elsewhere should ensure that your TRNC will only deals with your estate in the TRNC and that your UK (or wherever else) will only deals with your assets in the UK.

You can download the Will template from the HBPG site. You DO NOT need a lawyer, notary, solicitor, or Bill Blogs.

You DO need, your passport, 2 witnesses, and approx 33 TL in tax stamps. Take all this to the court offices in Girne and it will all be completed, redsealing-waxed and absolutely legal in about ten minutes!!



This is the very easiest of procedures here

You need to go to the Registrar's office at the court which is on the ground floor 2nd door to the right of the stairs as you look at the building then 1st door on the left. Stamps to the value of 32 tl and 6tl per person. We didn't need an envelope they provide their own at the office. Simple & straightforward.

One question though. Does one have to register the Will at the Court nearest to one's property?

I see that the address is not required on the document, just a name, so would location matter?

Its just that our friends who would witness it live on the other side of the island, and it seems sensible that we would go to their nearest court. TIA
