I have just recieved another e-mail from my builder asking for the VAT. I refused the first time by stating that VAT was payable only on transfer of deeds. He now says that if I don't pay the VAT I will have to pay interest and penalties. Can anyone give me advice please. David

Considering the KDV isn't his, you have to wonder what his problem is, and i'll bet he needs some cash!! Our conveyancer says they always get the builder to pay their taxes before the purchaser, and I certainly wouldn't pay it to the builder, if he spends it, you'll have to pay it again! Needs to be paid through your house conveyancer.

email both at once 'to' and 'cc' with all info on one mail then they can both see what's going on, if the sol replies only to you in your favour, forward on the reply to the builder.

Hi Jachin, Just to give you another solicitor's view which I received this week. The VAT office is allowing builders to collect the tax. Solicitors advice is you must obtain a factura fom the builder when you pay. I have told my builder he can collect the money from my solicitor to whom I have paid it but only with the correct documentation.
