The Oram's lawyer Mr Beasley has spent the morning countering yesterday's arguments on the matters of public policy and bias. He has done this brilliantly with lots of references. The judge has asked Mr A what he's looking for in the way of damages and this has left people wondering why he has asked this question.



There is a possibility of a judgement this pm.

I'm getting feedback from two people in the court who post whenever they can, last post was 15:32 Cyprus time. It should be a straight loss for the Orams but anything other than that would be amazing.

It's finished. No judgement today as the the Presiding Judge said a draft verdict will be issued later. We could be days or weeks away from issue of the judgement.

As a matter of interest, do the judges in UK give a "draft verdict" first, discuss it with the parties and then finalize it? This is new to me.

Good point Ismet - what exactly is the point of a 'draft verdict' - who else will be party to its agreement? and what will the final verdict change if the draft has been issued?

Never heard of a 'draft' verdict', maybe it applies to Jury cases where the Judge totally disagrees with the Juries decision. Not sure however, the Judge has time for a few cocktail parties to attend at Nos. 10, the Greek Embassy and a freebie to Brussels before he delivers Judgement!

As far as I am aware a judgement (not draft) has been made but judgement has been reserved. Therefore the decision can be witheld for a period of up to 3 months. This information is from the Royal Court of Justice. I would love to know on what basis it assumed that the Oram'shave lost their case. What went on in the court room to make this assumption?

I think it was a misprint.It is not a DRAFT verdict we are waiting it is a DAFT verdict as this is surely the only outcome.



I am not surprised by the delay.The court was probably quietly instructed not to do anything to interfere with the talks.



Result - delayed until talks collapse then mobilise the JCB's

I found another draft verdict here WRT intel:

This implies in the Orams case that the appeal will be upheld and the question of how Apostolides will be compensated could be up for discussion before the final verdict. This may then bring into play the North's property commission?

the court of appeal has to decide the issue infront of it and has to abide by the decision of ECJ. So in that respect I am sure the CA will overturn the decision of Justice Jack. That means that Apostolides will go ahead and file a writ against the property of Orams. At that stage Orams may argue that there is an alternative remedy to Apostolides i.e. may apply to Property Commission for Compensation. I don't think its worh bothering with this argument because when there is an alternative remedy in law, the applicant is free to choose which one he goes for. This is established norm.

Reserved judgment means the judges have retired to consider their judgement. They will discuss between themselves and then issue a wriiten draft judgment, which may be either unanimous or a majority decision with a draft written dissenting opinion. These drafts are then submitted, on sworn secrecy, to the parties' legal reps. for factual correction only with no comment on the judges' decision. The final judgment and dissenting opinion (if any) are then handed down and read out in open court.
