It's hard to believe that they are being forced to fly out to Cyprus so near to Christmas. What about those that have to work? What about their children expecting their parents/grandparents to spend Christmas with them. They wouldn't have done this over Bayram. It's absolutely disgusting.

Afraid to say it does appear quite deliberate. However that is not to say that a case in UK would not be called with similar short notice.



For the ABAG Ladies, would this have any link to the fact that Mr Robb's legal team has resigned according to CT? Is there a probability in that case that the people will get here to find the case adjourned or whatever?

I know you will think this is harsh and for that I am sorry, but do you really think that a Court in any country in the world should have to consider the nationality of the plaintiff, what their religious beliefs may or may not be, their family arrangements, etc, etc, etc. I'm sorry but it is not "absolutely disgusting". If the courts are in session and your case is due to be heard then I'm afraid you have to make yourself available. Unfortunately, it is one of the downsides of initiating a lawsuit in a foreign country.

joandjelly, I don't think you quite get the point. Robb can't appear and that seems acceptable but if the plaintiffs can't appear the case is cancelled! The case had been moved from 4th December to fit in with Robb, it doesn't matter that the plaintiffs had come over. They could keep doing this until one-by-one the plaintiff's cases are cancelled because they ran out of money and couldn't afford the fares and accommodation. Does that sound like justice to you?

The bigger problem will arise if we find out (and we do expect to) that in excess of 100 AGA cases are to be heard over Christmas - do they really expect every AGA Victim that has a legal case against AGA to travel to the TRNC over Christmas, we are not talking only one case - this is just an example on the blog of an email received by 1 AGA Victim, we expect to receive more of this type of email over the next few days



All victims should contact their lawyers immediately to find out what their personal position is

We have been told that the judges are sick to the back teeth of these cases and that all AGA cases are to be pushed through before the end of 2009, our source is normally very reliable !!!

Yes, absolutely the case. we are just awaiting confirmation on a few more facts and then we will post a blog on the subject with other emails that we have now been sent regarding extra costs being asked for from the lawyers covering valuations etc.......

Malsancak my comment was a general one regarding how courts operate. I do not know the full background to this case, how would I? I know it is an emotive subject but unfortunately the reality of being involved in a court case in a foreign country is that you will be expected to appear in court as and when the court sees fit.

Thank you all so much, your kindness really means a lot, some of us can't understand where they are coming from, after 6 years of hell, this is what they now dish out to Aga Victims, gave Robb his Kimlik Card, allowed him to do anything he wanted, at our expense, now they along with Robb have taken our money and abandon us, what corruption within!!

I support message #4 in their comments. Last year my case against the builder was due to come up before the court in December, sometime, and my lawyer advised me to standby to come at a couple of days notice if we secured a court date. I don't see why an ex-pat should expect the luxury of the legal system in a foreign country accommodating my holidays and personal arrangements, get real please.

Also on a personal note, I consider it would have been totally stupid of me not to have come and represented myself in the case to the judge, in person. This is not the sort of thing you "fire and forget", a case needs managing and that is the individuals responsibility alone.

And as for the message title, "The legal system etc etc... I consider that to be Inflammatory and totally unnecessary in this environment, it's just not the way you want it to be.

Tony E (elkiton) message 24, you should try to put yourself in some Aga Victims position having lost my husband through all the Aga rubbish, now many Aga Victims are very ill, both mentally & physically and I'm sure Tony E is a very strong man, The email that is posted on the blog is from a lady whose husband has recently suffered serious illness and is unable to fly., She has been given 12 days to get him to the TRNC to appear to court - not possible due to his health, also how will the airlines accomodate what could be over 50 families wanting to arrive in the TRNC so close to Xmas for court cases week beginning 22 Dec. To date this is the ONLY email that has been received - we dont know if more will be sent - but 22 Dec gets closer. Todate there are 5 deats on Stansted - Ercan 20th Dec - not enough Tony - any suggestions. Its not just 1 person it could be up to 200 !!!

and on a very personal note, this is the first Christmas without my husband and 6 years since our life savings went missing, and it is extremely difficult, but what is even more difficult to understand is why it has taken 6 years (for me) and until the 12th December 2009 from October 2003 to be told we may have to be there on the the week beginning 22th December, this Tin Pot Government/Legal System is very clever, they want to wash their very dirty hands as quietly as possible. You consider this to be Inflammatory - TonyE "you ain't seen nothing yet !"

A court in the Uk (& in most other countries I think) would give sufficient notice to all the parties of the trial date and ask for dates to avoid well in advance. No way would a court give less than a months notice. In these cases the process has been going on for years, why the sudden urgency?



How many times have I read on this forum of people who have finally got a judgement having had to turn up at court many many times only for the case to be adjourned because the defendent hasn't turned up or other such reason?
