Geoff & I would like to thank those who took time to turn up & support us today, we have been to court so many times over this matter & to have the support was a wonderful & to know that we are supported is very much appreciated & yes 100% it does help not only in the court but also in mind, once again thank you.

We should have been in court at 9:30 but was told later that we would have to come back at 2pm (nothing unusual) builder not present & has never attended court to date. On our return our advocate went into chambers with the judge she then informed us that the judge feels that we should try to come to some settlement with the builder on the civil action & that he may then drop the charges against Geoff.

We will do as instructed to show good faith ect. as we feel that we are in a no win situation. If no settlement is reached then we are back in court on 20th Jan 2010.

The good from today was that the Turkish press attended court for another matter & have now been introduced to us & are going to report our story & hopefully others.

Wish we could support you, but not out there at the moment, can only send our best wishes which I appreciate is not much help, but maybe sending positive thoughts to you can do something good.



My OH has invested far too much over there, against my wishes, as far as I am concerned, he might as well have gambled the money away.



Let's hope they find oil off the coast, then let's see how things go!!



Seriously, I hope if there is a God, things will fall in your favour, it is a horriblle situation to be in and I think you are both very brave and honourable - something they need to learn about over there

It sounds as though the judge has simply (and so predictably) given this rogue builder the 'upper hand', so that he has all the bargaining power. This is absolutely typical - 'Make a settlement!' - exactly what happened to us when we were entirely in the right, as you nice people are. I met you once - we sat together and chatted at a table in the courtyard at the back of the court.



In any civilised society, this bastard wouldn't be able to get away with all his lies and should, long ago, have been condemned by the court for presenting false evidence and subsequently sued by you for the utmost distress and financial loss he has so evilly caused you. It hardly needs to be said that he is obviously devoid of any conscience whatsoever.



We, despite our losses, have eventually got over our 'do', thank God, and put the whole iniquitous affair behind us.



I trust you will have a speedy conclusion to this ongoing nightmare.

I sympathise with you both my builder still has not finished our villa although we moved in but I am now worried if I throw all his junk away like water tanks arch frmes etc will he accuse me of theft when I start having a go at him about completing the project

I am somewhat disturbed about msg. 2 above. It implies that there is a possibility of the charge against Geoff sticking if it goes to trial, hence the efforts of the judge and his advocate to avoid this if possible. What Geoff took without the permission of its lawful owner may have very little value and he might have considered it abandoned but technically he may be found guilty. He may get a very small nominal fine but it becomes a matter of having a conviction record and that can give Geoff a very big headache. Hence the attempt to reach an amicable settlement and have the complaint withdrawn.



Obviously I am not privy to all the facts but I can see where all this is leading to. In my view its best not to take any chances that cannot be afforded. Ultimately its the judge and not the papers or the crowds outside the court that will decide on the final outcome based on full evidence.

I was atttacked by a knife wielding t/ c when I insisted on him being charged he made an accusation against me the poice with out any evidence made me attend court !!



I was told if I withdrew the charge against the t/c then the charge against me would be dropped !!



Justice in trnc for foreigners DO NOT HOLD YOUR BREATH

You may not be privy to all the facts - but you, as a highly knowledgeable man of the TRNC 'way', and if one 'reads between the lines', seem to be advising Geoff & Mary to pay this heinous 'builder' in full, so he'll withdraw his complaint of theft.



In other words, you seem to be insinuating, like the judge, that unless they do, they will inevitably end up with a criminal record, which if taken a step further could 'give Geoff a very big headache' - by which, presumably you mean 'deportation', or the risk of?



Please answer this honestly, Ismet - for the sake of these thoroughly decent, but so unfairly mistreated and maligned, innocent people.

I hate to give in to threats but at times we have to be realistic and act sensibly. Give me all the facts as you know them and I will give you my honest opinion. However will it be fair to Geoff and Mary to discuss the full facts on an open forum? I rather not think so. If you send me the full facts privately, I will answer you likewise. If you have the consent of Geoff and Mary and put the full facts here i.e. what the arguments and the evidence against them are, then I will give you my honest answer accordingly *based on the facts given*.

Is that fair enough? You must not blame the messeenger for bringing bad news.

Of course I don't know 'the facts', but I do know what racial discrimination is; and these innocent people don't deserve to have been treated the way they have been and still are - 'taking a sledgehammer to crack a peanut' coins it very well.



Nobody, including myself, is 'blaming the messenger, Ismet - but I think we all know what injustice and victimisation are when they're so blatantly staring everyone in the face over this utterly distasteful and uncivilised farce.



One doesn't have to be a Philadelphia lawyer to work out the rights and wrongs of it all!

I see injustices on a daily basis but I have seen no evidence of racial discrimination. However I have seen very bad discrimination against the poor, helpless and usually uneducated people. You must be able to see the picture from a wider angle before you can reach that conclusion safely. I am not convinced about racial discrimination but you must not expect a positive discrimination either.

Tenak, More "rabble rousing" than wise contributions? Too much angst here generally, maybe from unwise actions, or if you prefer, the actions of the unwise? So let me post from the opposite end of the spectrum.

I see nothing wrong with events in postings 1 & 2, inconvenient yes, detrimental no. The judge has suggested a way forward, and thinks of a "negotiated settlement" before a costly court battle.

Having been in a similar position, I did not get 1000% of the settlement and damages I wanted, but my solution was ratified by the judge, and a court order made out in our favour allowing me to "win the case", getting satisfaction and opening the way for further action should circumstances require it.

This is not "nice old England", and if you think that litigation in UK easy, forget it son, I have been there too.
