"..The certificate can be used to mortgage the property..."

how can they mortgage a property that doesn't belong to them?

"...It also makes clear that any claims should go through the courts of the Republic of Cyprus.

The reports said these changes were aimed in preventing any court decisions that would reverse the role played by the Guardian.."

They obviously don't want any claims going outside the ROC, (ECHR for example). I wonder why?

In another article it says

'The new bill affects refugees living in government housing or self-built homes on government plots. It will not apply to refugee families living in Turkish Cypriot homes or properties built on Turkish Cypriot land. Instead, as compensation, they will receive a plot of government land in the district they currently live in.'

Vidal, that previous article seems to have been superseded by the Interior Minister's new cunning plan. So, if the GC refugee defaults on the mortgage then the bank owns the property?

Malsancak, "So, if the GC refugee defaults on the mortgage then the bank owns the property?"

Let me get this right - this is the GC refugee who is living on/in a TC property and has been given an "ownership certificate" so that he can take out a mortgage on the property that is not legally his. That's all right then because the RoC is an Internationally recognised country. Would hate it if there were double standards being applied.

No, RoC being internationally recognised makes no difference, the ownership lies with the TC not the GC trespasser. The GC refugees are protesting that they were promised title deeds and so the government is trying to fudge the issue.

This was posted on the HBPG website a couple of days ago and is, I think, relevant to this debate.

Pinheiro Principle - everyone has the right to have their property restored to them or to be compensated for that loss. Well yes, that's what they're trying to do. Be careful though the Catholic Church might want back all the property taken from them by Henry VIII.

Just read the comment to the article from Mr Smith of ROC. he wants everybody to have the right to return. He does not say how this could work.

If everybody returned ,that would mean returning to the demography of Cyprus pre-74,Believe they were in practice enclaves for the TC's please see my link from http://en.wikipedia.org/wiki/File:Ethnographic-1.jpg. It shows most Greek areas to be connected while the Turkish areas are

It shows most Greek areas to be connected, while the Turkish areas are all enclaves separated by Greek areas from each other. Looking at the map I now realise how terrifying it must have been in the 60's for TC's, when the trouble started, to be thus separated from mutual assistance. To return, would require a huge leap of faith to put oneself totally at the mercy of others.

90% of people in Kyrenia would have to move out and become fragmented. Totally unrealistic.
