| I am a concerned homeowner with a property in Karsiyaka North Cyprus. Boyut is my builder and have not had any replies to numerous emails that I have sent. I know they also owe the AKFINANS Bank money as that is what is holding up my deeds amongst other issues like a thoroughfare but I accept that is not their fault. For the last 18 months everytime I have spoken to Harriette in the Office she always says 'Firhat is seeing the Bank Manager" like latest was 3 weeks ago and guess when he was seeing Bank Manager haha the day after! Now this AKFINANS has come to light on the other site with another builder, I am concerned about my location and all the other customers of Boyut. |

| Nick When people are worried about their property like this, stupid *supposedly funny remarks* do not help at all, I realise you get a lot of pleasure from running down TRNC but have a bit of compassion for someone who is obviously concerned as to what is happening with their property. |

| I have a court case against Boyut on Monday morning 29th March. My daughter and son in law have sued Boyut and Firat (as guarantor) through me for 12 months late delivery. It was supposed to be finished by the end of 2008 and its almost complete but work stopped months ago. The case has already been postponed about four times to give them a chance to file their defence. Last time their advocate appeared in court very early in the morning before my arrival and got a short postponement. I will be in court first thing in the morning and press forward i.e. I will ask to be given a chance to "prove" my case in the absence of their defence. Probably it will be put off for a couple of hours or a couple of days to give them a last chance to file their defence. There is no escape and after this one I will sue them again for late delivery starting from 1st january 2010. We are in a much better position than most because a) The owner Firat is a guarantor and thus he is personally responsible |

| even if his company is bust, b) I could afford to buy my daughter and son in law another villa, thus I am not in a hurry. c) We got the share title deeds from the start so nobody can take that away from us. I drew up the contract in person and everything is laid down very neatly. For example we are responsible for the proportion of the transformer cost and not the whole infrastructure. Thus all he has to do is to pay for the transformer and show us the bill. the extra costs will be billed in accordance with the tariffs of the Chamber of engineers. He cannot ask for more as he likes. He did but he was told to make a list in accordance with the official tariff. Of course he has not done so and thus he has not been paid for it. The place in question is a small development behind The Ship. We bought two units and made it into a larger single unit. Unfortunately the financial situation of the company is not good at all. ismet |

| Thanks for that Elko, Be interested to hear of how your proceedings went. I have no interest myselfe(yet) of taking any action, but as mentioned earlier are basically getting fed up with being fobbed off with excuses as to why I still have not got me deeds or a route to gain proper access. I have emailed a few times since last time I was told that Firhat was seeing AKFINANS(amount of time I have been told he is conveniently seeing this guy he must have a standing visitation order!!) But since that both the AKFINANS Bank have come out with their "nasty piece of work and timing" and have had no replies I am concerned. Thank you to Hattikins and Baldy for their support and its a shame that some childish people can get access to abuse what is a very informative site. |
