If you rent a villa on a long term contract who would you say is responsible for the garden, if it is not written into the contract?

I'd say the tenant.



Unless its stipulated in the contract that the rent includes garden maintenance.

For the rents you get in the TRNC the tenants should be responsible for the garden. If the villa has a pool, they should be responsible for that as well.

Vidal is spot on. However, just to be sure, it might be worth including in the contract that the tenant is responsible, that way it is indisputable.

If not stipulated in contract it will not get done. Even if it is in the contact chances are it will still not get done unless you have someone who like to waste their energy on something that is not theirs.

I wouldn't expect the pool to be the tenant's responsibility, unless agreed and specified.

As I see it, it is part of the house being let, and I would expect whoever is managing the property rental to be responsible for that.

This is cy, get it all down in black and white then theres no disputes, the rental management wont spend 60 quid a month on your pool if they are getting 10% of the rent will they? I rent a lot of properties here if you got it in the contract you can just point it out polity and say you must have overlooked this point !!

Assuming that the contract is silent on these matters, here is my opinion whatever its worth for.



The garden: The tenant has no duty to look after the garden, perhaps he likes it all brown and untidy



The pool: If the tenant wants to use the pool, he better look after it, otherwise he may empty it or keep it full if he likes the sound of frocks in it. It is his choice. Things get more complicated if he uses the pool in the normal way and something goes wrong like a burnt out motor. It should be the responsibility of the owner to get it repaired. If the owner does not get it repaired, the tenant can have it repaired and claim the expenses but he cannot deduct it from the rent. The cost of repairs is a separate issue altogether.

What is the point of the post are you renting ? or are you about to make up a contract to let your place ? My guess either way it would make no odds..even printed in black and white..Its been known that both landlords and the tenant end up doing whatever they so please ! and i can talk from both sides ! and please dont mention the law remember the thread not so long ago about trying to evict I wonder what the poor chaps having to deal with now ?

send the big boys round thats a laugh..Having been there and have a hat saying so, My thinking when there are problems is bide ya time mate just sit back and wait..and wait some more,Then surprise the sods when they least expect it ))

Its was a verbal agreement about the garden. The tenant gets a really good deal with the low rent for this villa with the pool included but the garden is a mess and they say it should be included in the rent now which would'nt be worth letting it out really. My fault should of had it in writing but you think you know people so well but alas not.

But if it is not in writing (either way) then they cannot expect you to maintain the garden. As Ismet says, if they like looking at a brown untidy garden then that is their lookout. I would question why anyone would rent a villa with a garden if they do not want a garden and if they do, then they should be prepared to look after it.

My guess is you will just have to leave the garden in the hope that they wish for it to look nice and may get going on it..Perhaps when the contract is up you state what you want on the new contract.But thats not to say they will do anything ! Perhaps you might not even renew their contract. Our rent is low £300.and we maintain the garden and pool.We like a nice place and keep it that way it is after all our home.I also must add that it costs us but that is to be expected.We have the most fantastic lovely place we could ever wish for and we have it for as long as we wish. A home is after all what you make it. Perhaps they do not feel at look at their situation in the same way. Maybe you could talk together and put all the cards on the table.!

Having rented here I always arrange to do the garden myself - I enjoy gardening. My husband now also does the pool - he had lessons from the previous owner.

We found that the biggest problem was people arriving at all hours to do gardening and pool work - sometimes day after day (particularly when there was a problem) at inconvenient hours without appointment or arrangement, no knock on the door - just entry into the garden which meant that they just turned up regardless of what you were doing or had arranged.

My son has rented a villa and the pool was empty - he has had to fill it, maintain it etc if he wants to use it - he had the option of just leaving it empty.
