I paid my money as per contract, got my ptp and then the advocate said they will see if the builder will hand over the deeds. An absolute joke, the system is a disgrace wouldnt pay em in washers..............

Sorry to say this but if estate Agents & Lawyers here wwere totally honest with buyers up front & forced, by law, to be transparent, then not a single property would be bought by anyone other than TCs, who do not require PTP.

There is no safe way for the rest of us to buy or own property here.

This isn't being negative or whinging. It's a fact that many who bought in the boom & have done since, refuse to accept.

Many who are still going through the buying process & haven't yet received their PTP will soon find this out, to their cost, & join the long queue of buyers without title deeds & many others with other major property issues as well.

End of.

You are exactly right Scruff.



That is the reason we are trying to get a good amount of information for people to take a look at while there is so much uncertainty. Usually the advice given is 'some guy down the pub said'.



Our advice from a highly respected advocate working in a very flawed system, take it or leave it.

I doubt my questions would be answered if I followed the link. Are TRNC advocates required by their Bar, or law, to have idemnity insurance, as are solicitors in UK, to cover their acts and omissions towards their clients (if not why not) and will they ever be required not to engage in conflicts of interest. (oh silly me, just remembered, we all know the answers already).

The problem Petez is the "flawed system"



No amount of legal advice can be taken as a certainty in such a flawed system. Advocates advice is dependent on their interpretation of the existing laws and there are so many advocate interpretations that we become even more confused and can no longer differentiate between sound advice or stalling tactics.



However I always look forward to reading NM's answers which are usually well explained and give a good insight into why so many people experience problems and how the laws and Advocates of the TRNC have failed to protect the buyer.



I am usually saddened by the fact that so many people with problems have to turn to another advocate as their own has failed to act or advise appropriately.



All in all, it is a sad reflection of the problems that exist for buyers and how peoples only avenue appears to be to dig even deeper into their pockets or be at the mercy of the courts.

I have been told that it is possible to have The Court declare you as Beneficial Owner of a property which the owner refuses to



transfer the kochan. I can confirm that I have paid 100% of my contractrual obligations (on time).



Could you please comment how The Courts would treat such an application.



Would it protect us from the builders bankrupcy, memorandi and injuctions, registered against the property?



I thank you in anticipation.

Whilst I think the legal 'profession' (I use that word loosely) in North Cyprus are a disgrace (I'll spare them further description), I do think that at least Naomi Mehmet is sticking her head above the parapet and providing free advice which none of her fellow advocates have the decency to do. She deserves praise for that.

True but if we get accurate answers we do know where we stand rather than throwing even more money at an insurmountable problem. I note her reference to new laws being introduced to protect future buyers but will not help those experiencing problems now.



Naomi must also get frustrated that her clients are let down by an ineffective legal system too.
