| We are currently going through the court process against Seaterra for taking out £2million mortgages plus unknown interest rate on the Reserve, thus breaching many contracts. Due to the directors failure to attend the past 5 court appearances and advise us what the interest rate is on these mortgages, it's our opinion that that the 4 companies involved are sister/phoenix companies, acting in a deceitful manner. Please note the many property auctions that are going on throughout TRNC, where buyers have paid in full and in good faith for properties which are now being auctioned off to pay builders/developers debts, effectively leaving the buyers with nothing after spending their life savings. No title deeds can be issued unless the mortgages are lifted. Also, if the mortgages are not repaid, Seaterra Reserve could be auctioned off in a similar way. On 1/12/08 Eyal Podhorzer said they'd repaid 50% of the loan, but on checking, nothing had been repaid at land registry. |

| I don't understand how people can offer these properties for sale knowing there is a huge mortgage on them and there are going to be court proceedings in the future or worse still they could be auctioned. Whilst I understand a desire to get rid of them, surely two wrongs do not make a right do they? What happens when the new buyers lawyer discovers there is a huge mortgage on the apartment? Do they not inform the buyer or do they just keep quiet and count their fee? The butlers wife |

| The Butler's wife - Unfortunately, Seaterra haven't kept to our contract/warranty. If the landowner/developer owes money to another party, the other party can take out a memorandum on the site, which overrides any owners contracts that have been registered at land registry, and could mean the site is auctioned off to pay these debts. This could leave the buyers with no property and no money left from it. IMHO, if a memorandum now can override a registered sales contract, it can certainly override any warranty or so-called mortgage exclusion letter that hasn't been tested in court anyway. The site looks lovely, but it's irrelevant if it's to be taken from you. Aymarina, perhaps you could tell us why the directors of Seaterra have failed to attend our court case for breach of contract on five occasions, and what is the interest rate on the £2mil mortgages. As the directors refuse to tell us. Transparency is needed. |
