I have bought on this development and was not concerned as had good reports on North Shore Estates; however earlier today was approached by another Brit in Girne who said he has problems and to take further legal advice as legal cases pending (mentioned bosses name).

I have a meeting with Gunesh Mentesh on Friday just before we travel back to UK so he can advise what searches we can make and ensure no charges/mortgages made on land that will bite us later on to prevent us getting kocan.

Has anybody else heard of problems with this development or developer?

Would appreciate any advice as this purchase was not taken lightly and been happy so far with what we have seen built.

I have many friends, clients and myself who have bought on this wonderful development and people should not be scaremongering before you are sure your facts are correct. I have known the developer and his partner for a long while and they both have very successful businesses in NC. I bought my unit totally off plan and after a trip over a few weeks we are absolutely thrilled with the way site is coming on.

I was told complete November but no chance of that and no confirmed completion date. My worry is about to pay 80% of money and penthouse 90% complete but rest of complex no where near.

I have have found all involved to be very nice and professional but why would somebody stop and warn me out of the blue? I accept individuals may have an axe to grind but I just need to be sure this development gets completed and not left as a white elephant as others have been. I was advised 100 builders on site July/August from Turkey to finish quickly but these never materialised.

I am not fanning the flames of concern but wish to know what is really happening to ensure all going to get finished and when.

This forum warns us that foreigners have no rights so it does not matter which advocate we use we are screwed if development not completed anyway?

You are right to air your concerns. This is about being proactive rather than reactive. Its about seeking up-to-date information so that you can take control and make informed decisions. Far to often buyers simply sit back and take reassurance from "the builders so nice" or "the site looks lovely". Obviously this means nothing if behind the scenes the builder has ran out of money and there are memorandums on the property.



Perhaps to allay your fears you could take the following action.



1) check there are no memorandums

2) check that all permissions/building regs are in place

3)communicate with HBPG, are there others who are experiencing problems?

4) set, with other buyers and the builder, a time scale for completion. This way you can see instantly if work is ongoing.

5) chase up your PTP and get title deeds as quickly as possible.



DO NOT ACCEPT BUILDERS EXCUSES FOR DELAYS......YOU ARE DRIFTING INTO MAJOR PROBLEMS.

Have seen recent photos and apartments nearly finished and external works progressing. I will see it for myself in 2 weeks when over for inspection.

Hope to Christ is complete soon as wife is staying there this summer.

every wall full of damp they wont do anything about it.

there a waste of space, no aftersales at all just the usual cyp tell you what you want to hear so you go away

and broken promises

Have you any idea why walls damp? and if less than 5 years old surely covered under the building warranty or is this a waste of paper?

Quite agree, I am a builder but don't hold it against me and would never walk away from a problem as believe a good reputation is better than any amount of advertising.

Went past this development recently and there seems to be much work going on. Looks to me that they want to finish it off soon as. However, it all seems very close to an army camp. Possible PTP problem for foreigners?

Message 6: don't agree with your assessment of Gunesh Mentesh at all. I've used him for years and he has sorted out several apparently intractable problems for me with great success. I've also recommended him to several friends who have all been very happy with his services.

Message 17, we applied for ptp in August 2009 for this development and have received confirmation has been approved so no issue with ptp for this development.

you may havce your solicitor do checks with the land registry now to make sure no memorandums etc however doesnt mean there wont be just after the search has been done.



what people dont understand is there are several issues when buying:

1. the standad of build

2. if completed as per contract ie all planning permissions completed as per date in contract bla bla bla

3. And a major concern is whlkst that kocan is in the hands of landowner/builder you are at their mercy and no matter how many searches you get your solicitor to do anything can slip in and I mean slip in at any time without you knowing. I have had dealings with your solicitor I wont say anymore on this forum but you need to bear this in mind when you speak and no matter what is said "theres no memorandum" just wait til your back is turned.!!! Ask if you can put a charge on your share or ask how he thinks you can protect your share

As far as I know, Laguna apartments were not built by North Shore, they bought it after the construction was complete, if I'm not mistaken.

I understood they sub contracted the build to a different builder, but either way they are the sellers and are responsible for rectifying any problems. A 5 year warranty is part of the contract.

Who did the actual build is immaterial. It could have been my granny. Indeed, I wish.........

I inspected 23rd June and they are working hard to complete and we move in end of July. North Shore believe they will have pool area complete by then but I do not expect that to be achieved.



My gut feel is that whole complex will be complete November at the earliest but cannot complain if we get in next month.

I believe they are concentrating on the landscaping of the complex, then doing individual apartments or penthouses as and when the owners require to get in quickly or not ??

Every owner on K5 got PTP no problem, does not mean there is not trouble ahead.



Agree with comment about advocate, be very careful, he once acted tfor K5 and during one meeting had the builder in his office during a meeting (who they were suing)writing out receipts for the advocates fees which they paid in cash, to be offset against their final payment to the builder. We all know what happened then.

Moved in start of August but when we left 1st September still no mains water, was using temporary supply. Will be chasing updates shortly so can be sure all complete when we come back at Easter.

News about Watergardens - from North Shore Estates



All buildings have been completed and the landscaping & livingpool will be completed within a few weeks.



There are no problems with the infrastructure and the Apartments are ready to move in.
