Hi



Trying to find out what you need to do. We have our land kochan's but our builder has

no intention getting our villa's put onto individual kochan's so we are looking to proceed ourselves.

We understand that there is something called a green project file that we should have.



Has anyone gone through this process and able to give us any further information.



Also there are three properties that have not and will not be built that appear on the original planning application. Will this cause us problems?



Any help greatly appreciated

I am in a similar position as many on our site. Is it a costly process for our builder to do this?

If you look on Naomi Mehmets website, there is a telephone no of a company that will carry our parcellisation for you. It does cost for this to be done and if your builder has no money, this is probably why he is reluctant to do this for you.

Yes I can shed some light here for you as I have had it in my hands.....



The Green File is the master file normally lodged at the Planning Office that contains everything to do with the planning and approval of the "Project" ie the site, individual plans, Kibtek stuff etc etc.



We required certain specific items from our file for a forthcoming court action (detailed engineering plans of the villa), and applied at Girne for it. It was down at the main planning office in Nicosia awaiting final site signoff visit, so they made the contact for us, we went down and photocopied the necessary items from the file.



Can you clarify something for me...When you say you have the land Kocan ......does the Landowners original document show you as having 1/9 share (or whatever) by name on it, or have you passed or nor reached this stage yet?

Our contract states 1/7 share with our names on, it also states that the Vendor will register the house and pool on the land but just been informed by Advocate that he most likely will not do this!! I would also like to know rough cost of parcelisation and would all seven owners need to do it or can you just do your own.

Also why go through the motions of drawing up a contract if the Vendor can ignore whichever part he likes, and the Advocate thinks its ok for him to do it!!!!!! Mrs TT

Thank you for the file information.



We have 2/14 and they are in our name on the Kocan as do the other residents.



We know that eventually we will have to pay to have the houses put on to the Kocan however our concern is that the builder may disappear before we get much further.



There are unfinished villa's and 1 plot never been built and we understand

that we can not get any further until the whole site is complete. Would this be right?

Hi barbaros,



I am sure you are right in thinking that you cannot get individual title deeds until the whole site is complete.



We have been waiting four and a half years because some apartments on our plans had not been finished.



They should be in the next month and then we hope to start the parcellisation process.

Its amazing that these "builders" have no money as we all have paid them what is due therefore they should pay for what is due from them !! they often boast about "no law for this "no law for that" but it definately works both ways !!!

Good luck for your site.



It is highly unlikely that our small site will ever be finished. I now know where the file is

which has helped. Thank you for that Diana.



Lets hope that in the future there is some forward thinking members of the government who

just might start putting a few laws into place that will stop all this lack of responsibility by the

builders. If there is any left then that is.
