Terry has left Goktug, Yildirim and Hamilton but I know not why.

I think he is probably still in TRNC as his band, Breakaway Blues, is playing at the Fez on 20th August.

Just get in touch with the company and they will let you know what is happening.

No wonder I didn't receive replies to my emails to him!

I heard he might be returning home, but think one should have

had some information about this. Pity. Have spoken to Yildirim last

time I was there as Terry was back in Scotland on holiday.

Hello folks,

I´m sorry to have worried everyone with my absence. I have left my position with my old firm and am currently in the process of opening my own office in Kyrenia. I will contact all of my clients in good time to explain how things will proceed.

Presently my new website with email contacts is under construction, which is why I have not been able to contact anyone to explain my circumstances. However, as soon as this is complete I will be in touch.

Best Regards

Terry Hamilton

I see you describe yourself as a 'Property Consultant' are you not a practising solicitor? I was thinking of consulting you re legal issues.

Hello Martin,

Yes I am a lawyer although my new venture is both in the spheres of property law and consultation, with specific reference to asset managment/protection for foreign investors. I am teaming up with local solicitors that will practice in the Kyrenia locality.

My new email accounts will be ready soon, so if you would like an appointment contact me on terry@bhlex.com is about one weeks time at, which point everything should be up and running.

Regards

Terry

Terry,

Interested in the "protection" for foreign investors claim. Do you think you could achieve this with current TRNC laws? Obviously many British purchasers feel that when things go wrong they have little redress.

A legal company that had more clout than other legal firms and was actually prepared to stand up and fight for their clients, would be in high demand as people are losing faith with the current system and the lack of positive input from their legal representative.

What can/will your team do that makes foreigners want to use your services?

How can you offer more protection to potential clients?

This could be a brilliant advert for you!

Bradus,

Our firm deals primarily with foreign investors and as such is wholly concerned with asset protection etc. Obviously we deal with each client file on an individual basis and thusly it is really impossible for me to sumarise or quantify how we approach the legal system and its associated constraints on a forum such as this.

As I stated above I would be more than happy to answer any specific questions you may have via my firm's email address terry@bhlex.com, which will be up and running by Monday.

PS The firm's website is http://www.bhlex.com again this will be completed by Monday.

Best Regards

Terry Hamilton

Terry, perhaps you can explain what you mean exactly when you say you are a 'lawyer'. I have had a look at your website which states that you studied 'European Business Law' at Abertay. As I understand it, from Abertay's website, the course is a BA in the structure of the European Union (not about law in general) and is only a two year course (the standard LLB Law degree is 3 years) and it is not accredited by the Law Society of England and Wales or the Law Society of Scotland to admit you as a solicitor. There has been much talk on this forum about lawyers' qualifications in the TRNC and what the requirements are to practice as a lawyer here and I would like to clarify how you are able to practice in the TRNC as you would not be qualified to practice or register as a trainee solicitor in the UK? I do not mean to be disrespectful, but I do think that this is a question which should be addressed and that all lawyers working in the TRNC should be made to justify their qualifications.

Why isn't there a list of lawyers giving their qualifications and graduation details like there is in the UK? Why isn't there any transparency? Why don't the TRNC government pass an act of parliament to make this law seeing as so many people are being fleeced by the people they should trust? Too many vested interests?

Couldn't agree more Macha. I don't seem to be able to get any information on what qualifications a 'lawyer' has to have to practice in Cyprus. Does having any qualification remotely connected to law count? What about A'Level law? There should be clear guidelines. At the moment the only way to get this information is to ask the lawyer what their qualifications are and look them up to see whether you think they really are satisfactory. There must be some real, genuine lawyers with good qualifications in Cyprus and I don't understand why they don't take action as these fake lawyers must be damaging their businesses/reputations? What's the point of studying for years if someone with no qualifications can set up in competition? This doesn't only apply to lawyers. There was a case where a phony doctor had given radiotherapy to a child cancer patient before his clinic was closed down! There have also been many cases of bogus dentists.

I shall be interested in Terrys response. It does seem to me that just about anyone can set themselves up as a advocate in NC. They are not regulated and don't carry any legal indemnity insurance to protect their clients. Their own head of their so called Bar Association has stated that advocates owe no duty of care to their clients. It is also their simple cop out to say that their client failed to ask them the right questions!

Phylray I did mention in my message that the degree in question is not recognised by the Law Society of England and Wales or the Law Society of Scotland - see message 25. Although the systems are different, I believe the qualifying requirements are similar. I believe that you have to have done at least a 3 year course with at least two of those years being devoted to law.

BIGCHEESE msg 25:

I've used Terry Hamilton for a number of things and he has always been first class, so although I understand that you aren't being disrespectful to Terry I really don't want his good name and reputation to be tarnished, as many others have, on this forum.

Terry Doesn't actually say on his website that he is a "lawyer". Infact it clearly states that his business partner OZGE BENGÜSU is an "Advocate" and Terry is a "Property Law and Investment Consultant". Infact, when i first met Terry, he made a point of explaining that he cannot represent me in a TRNC court of law and that all legal works will be carried out by his partner Ozge. He can however advise on all the legal aspects of purchasing property etc. in the TRNC.

Whether he is/was a practising lawyer in Scotland I don't know and I really wouldn't know where to start to find out, but I can say that in my dealings with him I have found him and his partner to be a breath of fresh air in what seems to be....

... a minfield of corrupt lawyers.

Terry and his firm seem to be doing things the right way and with their clients best interests at heart. So many people on this forum moan that there isn't a good guy out there when it comes to Estate Agents/Builders/Lawyers... but when one comes along some "BIG CHEESE" has to come along and bad mouth them as well!!!

Maybe you have a hidden agenda BC, I don't know, but you should let the guy get on with doing the good joc that he is and stop stiring up trouble!

Nobody is 'slagging anyone off'. I have asked a legitimate question which is directed at Terry himself to allow him the opportunity to reply. If I wanted to 'slag him off' I wouldn't have asked him the question himself. He is on this forum at message 21 saying he is a 'lawyer'. I have just asked for clarification of that term. What does 'lawyer' actually mean?? What qualifications do you need to 'advise on the purchase of the property in the TRNC?' There are many people who could offer an excellent service in all sorts of jobs, but that doesn't mean they are actually qualified to do them. I am sure that if I were a doctor, I would have an excellent bedside manner and my patients would think I was great. That doesn't mean that I am qualified to diagnose or treat people! I am just trying to get to the facts of what a 'lawyer' or a 'doctor' or a 'dentist' or an 'estate agent' actually mean in Cyprus. If Terry's qualifications are valied and he is doing a good job for his clients, then

There are so many of us in the TRNC that are being duped ,cheated, illadvised that we cannot afford to be lax in choosing those we trust with hard earned money not to say our future. surely it would be remiss to criticise those who are wary.

As a solicitor(non-practicing in TRNC) of the supreme Court England and Wales, but still on the Roll, I must say until legitimate questions such as those raised by Bigcheese are asked of anyone holding themself as a lawyer in the TRNC only than, upon satisfaction, one should proceed with instructions. A lawyer, qualified and on the register of the relevant regulatory body of a country, offers not only a service of trust but also if things go wrong, as Occasionally they do, a redress. Lawyers can, and do, be negligent but one must not conibute by not asking all the pertinent questions before engaging one
