Don't forget you need to lodge your will at the court. passport and 36Tl stamps each needed.

If you are doing a simple (or a back to back will) then do it yourself/partner its cheaper than going to an advocate however good. (about 40 lira each) If you have a lot of stuff out here and lots of people to leave it to, then go to Naomi or other. We have made the simplest we could - everything to the partner left. Then it will be up to that one to sort it out further for themselves once Probate is through. Remember you still need another one for anything you have in UK.

Ok so got the template. Whoevers name is entered onto the will also needs his or her passport number. Does this mean you have to amend the will each time a passport number changes?

No I wouldn't think so as your passport number will be on the computer.

I have a 10 year driving licence and when my passport was changed I asked the police that same question and they said no.

If you discover differently could you post on the forum please.

I got several emails from people who downloaded the free, blank "will" from my site (read messages 2 and 3 in this thread) but couldn't decompress the zip.file. The simple reason is that you don't have the (standard) software on your computer to decompress zipped files. You can donload the necessary unzip-software here: [ http://is.gd/fblio ]

But, then again, I've only lived in Cyprus for 30 years - North & South - but could relate umpteen circumstances where sole beneficiary widows have been cheated out of their rightful and intended inheritance.



To appoint a Cypriot 'lawyer' as an 'Executor' is tantamount to giving him/her 'carte blanche' re. 'testimentary expenses'!



Anybody remember this little song?



'My *father died the other day and left me all his riches,

A wooden bed, his wooden leg, and that was all his riches!'



*For the purposes of relating the above little ditty to Cyprus, one should substitute 'husband' for 'father'!

Not wanting to be a damp squib on saving money or adding to the superfluity of negativity on this Cyprus 44 I still thought it would be advisable to point out the following: -



“It seems that in the United Kingdom the biggest reason for wills failing, i.e. being rejected for Probate, is down to defective attestation (this is the witnessing; both who and when). This failing is most frequently found when DIY wills are presented for Probate. The proper procedure is surely mentioned in the instructions of the DIY will package but the potential for missing this one vital point is very high.”



I assume I missed the instructions in download of the simple TRNC will explaining the who and when of witnessing or is this not important in the TRNC like it is in the UK.



The other advantage of using a professional is because they can be sued for any mistakes made giving peace of mind that a DIY will does not afford ones loved ones.

Sorry point noted and that was NOT my intention. I should have made myself clearer. I believe there is a distinction between complaining about a grievance and being negative about a post. It was the latter that I was fearful of doing especially when it comes to a money saving idea.



So if I have offended or folk feel wrong accused I am sorry that was not my intention.



For the record I have thankfully not had to sue in the TRNC and as such my post 17 should be viewed in that light and thank you for the insight others have brought see post 19.



The point I wanted to make and still stand by is great care should be taken with DIY wills. (I guess like anything DIY fine as long as you completely know what you are doing).

The point I wanted to make is that you won't find a TRNC 'lawyer' willing to sue another 'lawyer'.



I tried, and was told that in TRNC legal practice that: 'This is unethical.'



So, whether it be 'No duty of care', or gross negligence [as in my case, both of which cost us half our life savings], any TRNC 'lawyer' can act without a scrap of accountability, and with total immunity and impunity.

In the England and Wales the main rules for witness of a will are: -



You need two witness and they must be over the age of 18

The witness can NOT be a beneficiary

An Executor can be a witness but they must not be a beneficiary

A professional advisor cannot be a witness if they are to be an executor and intend to charge for their services.

The witnesses must see the signature being signed and sign at the same time with the date reflecting this. A lawyer’s file note should carefully reflect that this has been the case.

The witness does not have to see the content of the will they only have to witness the signature being signed.



I do not know what the rules are in the TRNC.

I was a IFA for 25 years, and looking at the TRNC will form, 2 things give cause for concern firstly no provision for having separate Trustees and Executors,and secondly Paragraph 5, which gives catre blanche to the lawyer for "charges & expenses",with this in mind I am now going to be offering a Will writing service with English worded wills, and also Private Medical Insurance, look for forthcoming adverts or hearing from you personally.
