Judge stated thatt she felt the builder and his brother's statements were not credible, that the electrician had seen the lights before although he denied it, that the witnesses for the defence were consistent, precise and truthful. The prosecuter shook hands with them both at the end of the case.



No costs have been awarded in this case.

Fantastic news. Justice prevails at last, even in TRNC. Lets hope this is the beggining of justice for all those who have not had any so far.



NCFP reports that the breach of contract award was £200,000.

Is this correct?

Has anyone nailed the builders feet to the floor to stop him running away?

No comment on the breach of contract case at this time, but I have a very positive feeling that this shows the TRNC legal system can be just. I was very impressed by the judge and her summing up. I think it bodes well for ex-pats who are feeling a bit dejected at the moment.

So pleased for Geoff and his family but a shame that the summing up and judgment was not made near the outset avoiding so much stress and cost. I am not a fan of the UK Crown Prosecution Service system in the UK in many ways but I must believe that given this case it would never have made court. I hope that this family have a superb Christmas and everything they could wish for in 2011 and beyond. That is the very least they deserve for the integrity, tenacity, and raw courage displayed throughout the ordeal.

Pleased for them it is all over, but I wouldn't compare their fate to CPS. The CPS's behaviour when not chrging police or regarding Assnage case leaves a lot to be desired for an EU country.

Mary really wants to thank all her supporters. She said they had walked into the court so any times and felt so alone. To see familiar faces in court and to read the good wishes on the forum has been a real boost for both Geoff and Mary.

Fantastic news that this unbelievable interminable farce has had a positive conclusion.



Let's hope that the reported £200,000 award is actually enforced and that Geoff and Mary receive it soon.



If the builder won't pay,they could always take out a memorandum against his own property.....that would make a nice change in the TRNC !

Pauline has just put a little tribute to Geoff and Mary on NCFP which will apear shortly.



To say she is happy for them is the understatement of the year. God knows they deserve a happy future and

God willing that is what they will have.



A celebration was held at the Windows Bar and it was punctuated by laughter and tears from us all.



This has been quite a week for Geoff and Mary and as Mary said, she hopes it will spur on those of you who have problems and give you hope.

Tenak, Nepotism may not have won in this case but we still have to wonder how this got to court in the first place. On the evidence made available it looks very fishy and corrupt to say the least.

Great news. Wouldn't it be good if the TRNC legal authorities held an enquiry into how the criminal prosecution was ever brought, what could be done to avoid such miscarriages of justice/ prevent abuse of the criminal justice system i.e. a CPS style system to review police investigations and decide if sufficient evidence to charge & whether in public interest to prosecute. Plus the unsupportable length of time this case re a simple low value theft took to reach a conclusion, no wonder they wont charge anyone with fraud, it would take decades.

I am very happy to hear the verdict, and never doubted that the outcome should have been nothing but "not guilty".

Hector; TRNC is an infant compared to justice systems in other European countries; where miscarriages of justice / abuse of the criminal justice system is rife in courts of law. And after huındreds of years they still have not found a solution! As for the length of the hearing, I am not so sure hearings are any faster in UK or any other European country. Judges, solicitors and prosecution are all the same all over the world. They delay things to get the right judge, the right time that will suit barristers for all parties concerned and so on

Also note that a "miscarriage of justice" would have been the case if the verdict was "guilty", hence there was no such thing in this instance (none that I have ever heard of in TRNC anyway and very rarely in Turkey if ever!). On the contrary, it is a regular well publicised event in England year after year!
