I'm currently going through court proceedings against my builder. Tomorrow should have been a judgement on compensation in Kyrenia Court, but have been told by my lawyer that the Civil Service strike is still on and stopping all proceedings. Can anyone confirm this is correct? Any ideas on how long this situation will go on for and the impact upon cases? (the last bit especially for Ismet) Thank you

Its a general strike for 28th January but Girne court should be back to normal on Monday. There has been a strike at Nicosia court (civil and criminal cases) for some time and it is indefinite at the moment. The good thing is that the judges sitting in Nicosia are finding time to write up their overdue judgements.

Yes, I can confirm this, There was a similar action a couple of weeks ago but not a general one, and I had to meet the judge in chambers as the court was not "open" for a couple of hours due to staff not reporting for work.

A question,.... for 2011 as a way of stopping people saying "not ready" or "this piece of paper is missing" on the morning of the case, they are usually now putting cases to open hearings until you have had a couple of months regular sittings, with a judge to try and reach an out-of-court settlement. I have just been through 4 such sittings and now have a "true" hearing date where the public can attend. Where are you in this process? drop me a line if you like elkin_tony@yahoo.co.uk

I don't mean to sound sarcastic, but shouldn't your own lawyer be giving you all this information, rather than ask us on here,who are not lawyers (except Ismet of course).

I agree but from personal experience it is aso better to get other peoples expereience and what they have been told by their own advocates and what they have learnt as believe me it can be a minefield, sometimes other peoples experiences with the legalities makes you better inbformed when being advised by your advocate!

It has occurred to me that the biggest problem with TRNC property purchase in particular is this... you have a contract with your builder/developer but you don't have a written contract with the Lawyer.



In the UK you don't need one because the implied contract is sufficient. Here, I'm sure it's not.

Hi Stella. I'm surprised at your comment in message 11, after all the observations made about lawyers on this message board. Advocates in the TRNC are not solicitors, and not bound by the duty of care we would expect in the UK. I consider it not only prudent, but based upon my experience, essential to inform myself of what is happening in the TRNC and this message board is vital in that. Further to that, thank you to all who have taken the trouble to respond - including you Stella :o)

I spoke with our advocate today - the courts are on strike but the tapu and tax offices are open as normal

Message 18, very familiar story. Saying that, my lawyer phoned me in the UK tonight. Sounds like the s**t has finally hit the fan over there. Prepare for a mass exodus of the wealthy TC's.
