Evicting a woman from her council home for failing to pay rent would breach her human rights, judges ruled yesterday.



Town Hall chiefs wanted to evict Rebecca Powell, who receives thousands of pounds in benefits, after she ran up more than £3,500 in arrears on the accommodation she was given because she was homeless.



But the Supreme Court said that – under the controversial European Convention on Human Rights – this would >>>be a breach of the right to ‘respect for a person’s home’. <<<

Papers that sensationalize stories (i.e. being selective about what they want to print rather than the full facts) are not worthy of being called newspapers.

Don't panic! The convention only applies to public bodies, so it is really only social tenants who can try this on. Private landlords need not be too worried.

I do not know the facts of this particular case (do you?) but I do know from previous experiences that the Mail (and certain other newspapers) go for shock tactics to increase readership numbers.

What the heck has freedom of speech got to do with it? We are discussing what the papers want to publish in the way of 'facts' and what they do not publish because it would make a potential sensational story mediocre.

The reason for the allowing of the appeal in the Powell case was that as the council had a continuing duty to provide the homeless Ms Powell with accomodation under homelessness legislation and had indeed offered alternative accomodation, it could not be said to be proportionate to evict the tenant, nor had this proportionality ever been subject to a review as required under the European Charter on Human rights.



For this and other reasons the applicablility of the case law is highly limited. I can find none of these very pertinent facts in the reporting by the Daily Mail in the linked article. Experience of the paper's editorial bent on such mattters means that I am not suprised by this fact.

As far as the UK press is concerned I would not recommend any. My argument is that people do not disseminate information from other sources. Most will choose a newspaper that reflects their attitude towards UK life and will believe everything they read in that newspaper. Disseminating information from a variety of sources is the only way to get a better understanding of the subject matter.

The way to stop this is to ensure all housing benefits are paid directly to the landlord, social or private.



In this case it appears she was too thick to claim what she was entitled to so the public purse in general has not lost out.



But hey! She has offered to pay it off at £5 per week which will only take her 13.6 years, assuming she now pays on time.



Like David has been saying nobody should be better off on benefits than they would being in work, Fundamental ain't it!

If you read about it even in the mail, you would realise that there is more to this story than meets the eye. She was not paid what she was entitled to in housing benefit which would have come up to 15,000 per year which would come up to 60,000 pounds and the council instead of keeping quiet about it and keeping the 56,500 pounds instead brought the matter infront ot the judge. What pillocks.

That's why the likes of the Daily Mail and its deluded readers are4 on a permanent crusade against the licence fee - they don't want the great unwashed being educated and informed as it makes them harder to manipulate.
