Marky, do you know if they prosecute people for speeding in UK with photos taken from the back and the driver not shown on it? Do they presume that the owner of the vehicle is the driver? ismet

In UK the registered owner is prosecuted for any offence unless they disclose who was driving at the time. A notice of prosecution is sent to the registered owner and they need to inform the prosecution service who was driver was. If they do not do so they will be prosecuted. Company Directors have been known to take the fine/points if they are unable to trace the driver at the time. So in reality it doesnt really matter whether your face is showing on the photograph. Most cameras in UK now take photographs of the rear of vehicles otherwise motorcyclists would get away scott free

Sorry last one should have said registered keeper, as the registered keeper may not be the owner.

doctorw it is against the law to take the fine or points if you were not drivein ,if the photo does not prove with out doubt and you can show you have made an effort to find who was drivein case will be dismissed.

There is a legal requirement for Company vehicles to keep a log of who is driving vehicles at any particular time. Failing to do so is punished quite severely. The same law does not apply to individuals in the UK Harold

Bet a few husbands and wives take the rap for each other. And you can bet a huge amount of money changes hands among people wanting to avoid a ban and someone happy to oblige and take the rap! If the price is right...

The Hamiltons claimed they could not remember who was driving on the night in question. They did not want to lie to the court saying one or the other and got away with it.
