Interesting but a little unrealistic. I have never witnessed a hate campaign on here, by and large the moderators cotton on quickly and things dont get too out of hand. IN any event one man's lie is another man's truth. It is all in the perception., OH and yes I think they refer to here and the other forums, NCFP and

NOrth Cyprus forum - sour grapes.

It could be anyone of 1001 forums (including yours). It is unrealistic to ask potential members to prove their identity on the internet, how do you do it? Yep I know, lets ask all potential members to come to the office and show their passports before they are allowed a login. Or lets log everyones IP addresses and just ignore the fact that some will disguise their IP address by using any of the available software programs available for free on the internet. Or get them to go to an Advocate and produce a signed letter stating that they are who they say they are. Unfortunately there are people that will slag off the way some boards do things but they are never capable of providing a solution. Easy isn't it.

This forum has let many people make unsubstantiated attacks on people & businesses time and time again and some of the moderators are so biased it stinks

I think, possibly, that the article is meant to be a warning to us. There is growing case law from around the world of people suing for libel, and winning, for comments placed on social networking sites. It would appear that where the media is based is irrelevant, and it seems that the courts have decided that the the residence of the plaintiff and the defendant decides where the case is heard.

The latest one in the UK is where a local councellor said on twitter that a rival had to be removed from a polling station by the police. He had to pay £3000 damages and £50000 costs.

So what you're saying is that because you can join an open forum and not use your real name, you can write anything you like, hiding behind anonimity, and there will be no consequences?

Yes, you can legally join sex/racists forums. It's not the joining that's illegal, it's the postings. And if a posting libels somebody who suffers a "loss" because of it, the poster is subject to the law. It's a whole new legal field, and it looks as if case law is deciding it. There is also discussion in Parliament (and I assume in other countries) to see how the law can be clarified to allow freedom of speech, but at the same time not allowing that freedom to go over the line.

One other point (and it's personal opinion). I believe that the forum (or blog, or bulletin board, or whatever) has a "duty of care" to ensure comments aren't libelous. That duty of care would also extend to any administrators or moderators, who could well find they are joined in any action as co-defendants

Yes they did. I expect his lawyer advised him it was the cheaper option. The agreement, however was conditional on being accepted by the judge. It goes to show that this is a developing area of law.

I agree, that the chances of anybody being sued on C44 are pretty remote. However, a certain bank are threatening to do so. (I expect the members concerned would be glad for their day in court and the publicity!). There have been posts in the past here that have resulted in the threat of legal action, and apologies have been posted for publishing libellous information. Indeed whole threads have been pulled for that reason.

The point I'm trying to make is that you can't publish anything you like and assume you'll get away with it. And being anonymous won't help. There's no such thing on the internet.

ianwfs, yes there is a possibility of anonymity but many ISPs keep a record of your use for 90 days, for example, and law enforcement agencies can gain access to these records. They can even show evidence of your use of an anonymiser and the forum records could reflect the use of the same anonymiser to create an illegal post. That would be enough to seize your laptop if they have suspicion you were involved. In the US even if you password your laptop with an unbreakable password and encrypt all the data that can be used as evidence of guilt if you don't supply the password.

Wikileaks exists apparently because whistle-blowers are assured real anonymity.
