Just spotted this article as they have broken down the financial package into key areas!!



BUT just wondering does this also mean that the package is close to approval or not-whats happening???



Or is it still being vetoed by Greece and ROC ??



Any further news would be great??

I can't give you any info, but I wondered if this has been anounced due to the impasse at the Sep 5th talks. Interestingly, objectives 4 and 5 almost look and sound almost like TRNC recognition

Also if the GCs accept the ruling we may be in for a bumpy ride??



But if they refuse as per usual the they will be in for a VERY BUMPY RIDE??

A possible approval by the European Court of Human Rights of a property exchange between a Greek and Turkish Cypriot is on the agenda. The European court seems to be in the final stages of deciding whether to accept a land exchange between a Greek Cypriot and a Turkish Cypriot. The European court will possibly ratify the exchange of properties in Cyprus in the case of Mike Tymvios, a Greek Cypriot who petitioned the Property Commission in the Turkish Republic of Northern Cyprus (KKTC) for a land exchange with a Turkish Cypriot. Now the case is in the hands of the European court for approval.



The move has far-ranging implications for all Turkish and Greek Cypriot refugee applicants to the European court, who would then have to use the Property Commission until a Cyprus settlement is reached.



If this request of both parties is ratified by the European court, then an exchange of lands will take place officially in the land registry offices of the KKTC and the Greek Cypriot administration. Following this decision, it is very likely that all the other appeals to the European court will possibly be conveyed to the Property Commission in the KKTC.



Another issue relevant to this property exchange would be the Guardian of Turkish Cypriot Property, which is part of the Greek Cypriot administration and is the only so-called authority in southern Cyprus legally allowed to return land to Turkish Cypriots who claim it back under the courts, if they have been residing in southern Cyprus for six months or more.



Turkish Cypriots would not need to be inhumanely forced to reside in the Greek Cypriot territories to repossess their property, if the current property exchange is ratified by the European court. To repossess their lands, Turkish Cypriots have since 1974 been forced to reside in the territories of Greek Cypriot administration, although they are citizens of the European Union. The European court will put an end to this inhumane enforcement, which is against human rights as well.



Although the Greek Cypriot administration claims that a Turkish Cypriot living in the territories of the KKTC could take the property of a Greek Cypriot refugee, it is unlikely that the reverse could apply, since Turkish Cypriot properties in the Greek Cypriot southern areas are protected by the “Guardianship Act.” The European court’s final decision will also nullify this law.



If the European court gives the green light to the property exchange, not only does it give legitimacy to the Property Commission of the KKTC, but it also puts the guardian on the spot because the Greek Cypriot refugee would be claiming Turkish Cypriot land not legally returned by the guardian, the Greek Cypriot administration.



A possible refusal by the guardian to accept the European court’s ruling, if it is in favor of the Greek Cypriot refugee, could propel the Greek Cypriot administration into a collision course with the court. The Greek Cypriot administration may very well say they don’t want to accept the decision to hand over the land which is under the jurisdiction of the guardianship, but the result will be a head-on clash between the Greek Cypriot administration and the European Court of Human Rights and, as a consequence, the Council of Europe. The council would ultimately raise the matter if the European court ruling was not implemented by the Greek Cypriot administration.



This case is a real nightmare in the policy of the Greek Cypriot administration and Mr. Palmas, who in his last statement stated that if this property exchange is ratified by the European court, the Greek Cypriot administration will refuse to enforce it.



The Greek Cypriot administration is opposed to this act and has requested from the European court that a private settlement for the exchange of properties in Cyprus be reassessed and the same day made an o

I have tried to decipher this but I am not sure if I have been successful. It seems to me that this ruling will only apply if a GC and TC agree to exchange land. I am not sure how many times this is likely to happen.

This is an interesting post. Sport has a unifying force. It might be pivotal in bringing the two communities together. Mind you if I was a really good TC football player I would rather play for Turkey, as they are more likely to win honours.

‘Don’t trust the property commission’

THE NORTH’S compensation commission is little more than a gimmick designed to lure misinformed Greek Cypriot refugees desperate to get something for their occupied properties, the government warned yesterday.



Government spokesman Vasilis Palmas was commenting on press reports that the commission was poised to settle a number of applications made before it by Greek Cypriots.



The government does not recognise the body, which was set up in the breakaway regime after the European Court of Human Rights told Ankara to come up with an “adequate domestic remedy” for Greek Cypriot property claims.



So far, around 200 Greek Cypriots are believed to have filed applications with the north’s compensation commission.



“With all due gravity, the government considers that, if and when [the commission] moves forward with friendly settlements, this will be of no consequence whatsoever,” said Palmas.



“It is our opinion that the so-called compensation commission in the occupied areas is a gimmick, whose purpose is to cause trouble for the Republic and act as a counterweight to the ECHR”



Palmas questioned whether the commission had the resources to cope with the applications filed before it.



“The costs involved, and the capacity of this commission, means that it cannot tackle the problems faced by refugees, as some of them try to retrieve their assets,” added Palmas.



“We are certain of this…and we urge all those who turn to the commission to seriously take into consideration this point of view,” he added.



The Papadopoulos administration has taken flak for not doing enough to move Cyprus talks forward, as a result of which – the argument goes –frustrated refugees are losing hope for a settlement and are taking matters into their own hands.



The case of Mike Tymvios, a Greek Cypriot refugee seeking to swap land with a Turkish Cypriot, has further complicated matters.



There are concerns the ECHR may accept the deal made through the north’s controversial property commission as an adequate domestic remedy. This could likely result in thousands of ECHR applications by Greek Cypriot refugees being forwarded to the property commission for settlement.



Moreover, it could put the spot on the Guardian of Turkish Cypriot Properties, which is part of the Cyprus government, and is the only recognised authority endowed with the power to return land to Turkish Cypriots. This can only take place if the applicant has been residing in the Republic for six months or more.



Were the Guardian to block the Greek Cypriot’s bid, there are fears Tymvios would take the Cypriot government to European courts – opening a whole new can of worms.



“We never said that the path would be strewn with roses,” noted Palmas yesterday. “But it is our duty to work within the boundaries of international law in safeguarding the rights of the people of Cyprus.”



Newspaper claims scam to claim Turkish Cypriot land in south

IN A RELATED development, Phileleftheros has claimed that Greek Cypriot realtors are in cahoots with Turkish Cypriots eager to sell their property in the south, by exploiting loopholes in the law.



According to the paper, Greek businessmen have resorted to devious means to get around the six-month residency requirement for Turkish Cypriots claiming their land back.



For instance, they would fake payments of water and electricity bills for six months, giving the impression that the house is being inhabited by a Turkish Cypriot. There have been a couple of cases, the paper said, that the Turkish Cypriot owner showed up to claim his property just hours after the six months elapsed.
