How absolutely devastating. I am so sorry that this has happened. I hope that the estate agent will have something to say (will they care?) People are living in a nightmare world and all they wanted was a bit of peace and quiet in their retirement without stress. I don't think we hear most of what is going on here.

I do not understand what it is that people expect of the estate agent involved? Unless I have misunderstood, the requirement now for legal advice and services in order to complete the sale is a result of the unfortunate bad health of the wife. If I have got that wrong then I appolgise in advance but that is what I have understood from reading the original thread, after filtering out the treats of violence and other rantings.

The problem is that the TRNC corner of Cyprus is very small, and without any help from the Government, legal advice is at best "Pot Luck" and at worst means "No Duty of Care" in effect it's become every man for themselves! Estate Agents should not be connected to the Builders, who should not be connected to the Landowners, who should not be connected to the so called Lawyers, who should not be connected to the Banks, who should not be connected to the Government, Incestuous liaisons are not good for the health of any Country? especially a Country like Cyprus that is already in turmoil! the South side is no better, Illness and death, threats of violence, filtered or otherwise will remain, rantings by victims will increase, my sympathy for the sad position of matula will stay, I hope Patsy manages to overcome her health problems and matula manages to keep looking after Patsy and keep sane!

I can only write as we found, Jez at Ian Smiths could have not been more helpful in the sale and aqdvice for our friends sale, our daughters, and ours. They are certainly the only estayte agent that we felt that we could trust. I have every sympathy for the gentleman and his wife in their predicament, but can only add - he needs a power of attourney, but it will not be effective as on her death it wiil cease. so the law in Uk states. Having done one during the last 2 years. Sorry.

I'm sorry but as much as I sympathise with Matula I don't think this name and shame of Ian Smith Estate agency has any place in this matter. Advice given by an Estate Agent who has no way of knowing of a client's wife's impending medical condition should not be subject to this abuse of freedom of speech. Even if you had gone to a lawyer (please note, there are no solicitors) they also would not have foreseen this eventuality, very sad though it is.

I have no connection with any party to this matter.

AJ, I would give the poster the benefit of the doubt, I think I read in another post that he has known Patsy for 6 years and the way things are at the moment he is probably hurting.

I am only guessing of course but they only joined yesterday and have posted 20 times and some have been pretty angry posts. Time will tell I suppose.

I love the idea of being mr angry, I am not defending Groucho, just trying to show a little leniancy besed on the fact that someone might be in emotional pain, I could be completely wrong, it certainly wouldn't be the first time.

Have to agree with Groucho here...I'm sure girderjack99 is hurting, and I'd imagine matula is hurting a lot more, but if I've pieced it together correctly, it isn't the fault of the estate agent. Although I had occasion to meet Jez two or three times when I was looking for a property a few years ago, I didn't in the end purchase through him, so I have no connection with his firm. But with me he was agreeable, efficient and professional.



I think this criticism of the agents is based on a lot of emotion, and as such really isn't warranted.



But I have a lot of sympathy for matula, and wish him strength and support in this very hard time.

I have never posted on this site and it is unlikely I will again, but I feel I need to respond to the claims made against myself and the company I work for, Ian Smith Estate agency, and to try and halt the slide into a free for all, as there are now two post’s on the same subject.



The situation that Ian find’s himself in, with his wife critically ill in hospital, is tragic, and most people’s worst nightmare. I can’t begin to imagine the hurt, sadness and bitterness he feels, and can understand he wants to hit out and apportion blame. It is a very human reaction.



The sale of the apartment has been fairly smooth, other than some last minute problems created by the purchaser. These have now been overcome, and we are in a position to conclude the sale. None of us could have possibly predicted the rapid decline in Patsy’s health, and this has made what would normally be a typical TRNC transaction, into something far more complicated, through no fault of myself, this agency or the

I stand by the advice that was given, regarding a solicitor. As a seller, why pay for the privilege of a solicitor reading a contract that has been drawn by the purchasers solicitor, vetted by us as a middleman, saying all is fine, and presenting a nice bill for his efforts. Most people feel the same, Ian Included, but ultimately, the choice is down to the seller. Their decision. If things had progressed as we hoped, without the unknown quantity of serious illness, then that advice would have proven to be correct. I, and all at Ian Smith, try our utmost to work for both purchaser and seller as many previous customers can vouch for, and if we do encounter obstacles, then we try to work together to overcome them.

How many more times are we going to be subjected to hearsay and half truth threads on this forum. It is about time that reputable companies such as Ian Smith and the rest take such cowardly posters as girderjack99 to the cleaners. Before you respond girderjack99 I would make sure you and Cyprus44 have the entire story with 1st hand proof to hand.
