I purchased an apt in Bufavento Village about 7 years ago and due to divorce was forced to sell as soon as it was complete.I sold to a local and my agent pursuaded me to give possession after receiving a 30% deposit with the balance to be paid when title deeds were issued,which my agent assured me would be within 3 mths max . 5 years later no deeds therefore no cash.I know I was niave to accept these selling terms but I trusted my agent . Is anyone in the same situation or have any ideas or advice

We are on phase 1 and got our title deeds last year. is it you or the current occupiers who have to apply for them?

You need answers from your agent if he promised a 3 months max for the title deeds? and if you sold to a local (was the local a Turkish Cypriot)? if so should have been no problem! why have you waited 6 years and 7 months?

Contact Emtan and ask them as they are issuing deeds almost everyone has theirs now. The buyers will have applied to get them. I am on phase two and we all have them in less than four years.

Just a thought hiw do you knoiw they have not got the kocan? Maybe their way of not paying you the rest of the money by saying that again ckeck with Emtan.

I know this does not help you with your problem but I think you should name and shame your agent - the terms you agreed were terrible. Maybe a 10% or 5% retention until issue of deeds but 70% most definitely not unless the purchaser took over the final payments?

Thanks for your replies . The apartment is on phase 3 of Bufavento & yes the buyer is a Turkish Cypriot .

Amazing coincidence since my posting , I have just heard that the title deed has now been issued in the name of Emtan , and I have a faxed copy to prove it, although in Turkish of course . Sorry fo my ignorance , but does my buyer have to apply to get the deeds transferred into their name , as I never occupied the apartment .



Still doesn't mean that I will get the cash but seems a little closer now

where is phase 3? There are only 2 phases on Bufavento. Emtan is the builder and we haven't had any problems getting our Kocan off him, in fact the opposite, he chased us up.

As a "Visitor" what good is the issuing of title Deeds unless you are looking to sell?

Of course the buyer has to get the deeds in his name! Its not your apartment any more payment made or not. Really.

as you are the seller the norm is a bankers draft is made out into your name on the same day as you go to land districts office. I persume you did an assignment of contract when you initially sold the property which would be between you emtan and the cyps buying.



your lawyer shall hold on to your draft and once all documents are signed and taxes are paid then you just need to collect your cq which normally chases in within 3 working ays if you bank into an account over here.

This is surely a wind up.there are only two phases on buffavento and as already mentioned Emtan are probally the only builder i have heard of that actually chase you to get the deeds.

thanks for the sensible replies & advice . I realise I'm guilty of being niave & not understanding the procedure , but i'm sure i'm not the only one .

Bufavento phase 2 or 3 , its an apartment overlooking the 2nd swimming pool . As for asking the question too late , I came to Northern Cyprus last summer specifically to visit my lawyer , estate agent & Emtan , and got the response from all that we they were waiting for the title deeds to be issued .

Everyone manages to sell without title deeds. This is an excuse. Not having title deeds does not prevent you from selling for cash.
