I think most of us are aware that you should make a will in UK but if you do not and the enevitable happens there is a process of intestatacy that ensures that eventually your monies go to someone in your family.



In the TRNC that may not be the case. If you do not have a will then that house that you may have finally aquired just before you shuffle off this mortal coil may disappear into the bottomless pit of the state!!!!



That is OK if you are a Norwegian Blue but you will have fought hard for that property so make sure it ends up where you wish it to and make a will.



You can hand over lots more money to your advocate but the HBPG have designed a pro forma that means all you have to pay is 33 TL per will for stamps by doing it yourself.



We did ours today and it felt so good not having to give more money to the money grabbing legal system here.

A valid subject but who is the will registered with ? and how legal is it



I ask this question because of the negative posts on NC Advocates recently.

Your will is kept at Girne Court Office and you are issued with a receipt to hand to your Executors.



It is then up to them to process your wishes.



If you do not use an advocate then it has nothing to do with them and takes money away from them by DIY. It is up to the executors how they handle the process.

Turtle the Will is registered at the court who issue you with a receipt as stated in the link above.

Sorry but is this the same "court" that issues PTP and Kocan or a dept in the same building....... and again I ask how legal & efficient is it ?



If I meet my maker I wish my family to "wrap" up my estate fairly quickly , has there been any instances of UK residents going through this process ?

Most of us are spending £100,000 or more for a property and we are trying to save £100 on a will done properly. I think some of us have lost the plot!!!!!

A will is not processed by a solicitor in UK it is done by executors who you appoint.



It really depends on how simple your distribution is going to be. Ours is simple, 2 benificiaries sharing equally. So no need for a fancy laid out out piece of paper that will have the same effect but costs potentially hundreds of pounds.



This DIY effort has the same legal standing as one drawn up in the UK using a pro forma from WHS. So do you want to give more money to the same advocates here that people moan about every day here. Any doubts contact HBPG they have already done the research, I am just trying to offer suggestions for people.

1. If you do not make a will your estate goes to your heirs in accordance with TRNC law i.e. the spouse gets 1/6 th of the share and the children get the rest.



2. If you do make a will, the Brits can give away as they like, other foreigners and Turkish Cypriots can give away only a certain portion. There is an "undisposable" portion. Different rules for other foreigners and TCs.



3. There must be two witnessess and not close relatives or a spouse.



4. It is not necessarry to deposit the will with the court but it is strongly advised to do so.



5. The witnesses do not have to attend the court and it can be put in an envelope without the clerk seeing it. However the testator must be there in person with his/her id papers.



6. The will can be in any language but if you get it done professionally my advise is for it to be in Turkish. It may save a lot of trouble and costs later on when the time comes.



7. Always make sure to state that it is your last will and you rescind all

previous ones. Also make it clear that your will covers only your movables and immovables found in TRNC.



8. Will someone ask Izzet to lift the limit of 1000 characters or at least make it 1500 cahracters? )

Thanks CIH for bringing this to our attention and thanks also to Ismet for his invaluable advice. We are having our wills done on Monday so excellent timing!
