| An injunhctioın may be granted by the judge "ex-parte" i.e. grants an injunction and then gives a chance to the other side to object. They may or may not object and that will affect the costs. On the other hand the judge may reject the "ex-parte" application and order the application to be served on the other side. Inevitably the other side will object and the costs can mount if there is a full trial. For example in K5 case, the judge finally rejected the application for an injunction and ordered costs in favour of Akfinans. So the plaintiffs have to pay their own lawyers plus the costs of the other side. Hence the cost can double. ismet |

| Listen to Elko, he knows what he is talking about. When I got my Injunctions in my Breach of Contract case, the stamp duty alone was mega and it has gone up since then, that is in addition to the Advocates fees and you have to have hearings, so more stamp duty, and then of course, they can be opposed by the person on whose property you want to put the injunction, be sure it is worth it before you start. Of course when you win the case and the injunctions become court memorandums, you have no guarantee of a pay out. If you want it on your own property, again that is different. Go to see someone for advice before committing yourself. |

| How come Mambosun asked the question about injunctions and Bazzagirl takes over the thread.Could it be double identity.Come on Mods you are supposed to be nipping this sort of thing in the bud.Just go through the postings of both and anyone can see there are one of the same and their motives of a vendetta against Sea Vistas. I have freinds who have property there and they are worried sick about all the adverse publicity that is spread by this poster.This has been going on for far to long,can it at least be investigated by the Mods to asertain wether or not there is an ulterior motive here.Where is Mr Ali,s estate agency in Karakum,has he met up yet with F.C.C. just so happens to be the management company for Sea Vistas that he wont recommend to his clients. If I am wrong I will gladly apoligise. |
