May I remind people interested in helping Kuluksiz 5 and their fight that there is a charity evening taking place on the 21st Sept at the Green Palace Restaurant, Karsiyaka at 7.30 for 8. Tickets are 35 TL this includes a 3 course dinner and there will be music and dancing. A percentage of this money will be going to the Kuluksiz 5 fighting fund. The issues raised by this case have implications for other property owners faced with similar difficulties - simple terms 'a test case' for others. I know the ex-pat community do themselves proud when it comes to giving for charity, please give your support. Today the court in Lefkosa turned down the appeal against eviction orders of the Kulaksiz 5. The battle now goes on to the High Court. We cannot and must not let the Bank win this case purely on strength of funds so please give us your support. As Rita said, this is a test case. Those faced with or about to face similar mortgage problems will benefit. There for the grace of god!

David, do you actually mean that the court refused stop the legal course of the Eviction writs, because as I understand it, each individual will have to answer their own writ and the court will deal with each on a one by one basis?

Please support the evening arranged for K5 legal fighting fund. Each resident who has received an Eviction Writ, the start of the legal process to evict will need to fund their fight through the courts. This in adddition to their fees with the other cases. They need your help and support more than ever now.



If they lose so does every other home owner with an illegal mortgage on their homes.



Sept. 21st Green Palace, Karsiyaka starts at 7.30 for 8.00 tickets 35 tl. All details above in Rita's post.

You are correct Pauline.

My understanding is that yesterday was just part of the process required before the appeal goes to the High court to ask for an Interim Injunction, to stop the site with the properties on it, to be sold on to a third party.

I cannot think that it was optomist42 becauseI am part of that case, when it comes to evcitions, I am not. I cannot think I would be delbierately excluded from a case that concerns me since I am a fee paying member of the KUlaksiz 5 v Akfinans cases. Yet I had no knowledge of yesterday's hearing. I read it on here just like everyone else.

optomist42, did any of the K5 attedn court yesterday and was it the emergecny application for the Interim Injunction Boysan mentioned at the end of the 265th August hearing? In fact the Injunction to stop the sales of the villas?

Pauline, Yesterday was not a proper hearing, it was a procedure that had to be followed before the appeal goes on to the high court.

I was told that there was no need for anyone to attend as the outcome was predictable.

No one was deliberately excluded as there was no need for anyone to attend.

I met the advocate their as they had some information for me but then left.

The same Judge, Talat Usar was asked to give an emergency injunction to cover the time from now until the end of the Appeal hearing, he refused. The object of the injunction is to stop the Bank selling our villas; something that would not be necessary in a civlised society, all action would stop until the outcome of the cases was known. This was at Girne Court.



I would have liked to opportunity to decide whether I wanted to be at the court or not but since the first I knew of it was by reading about it on here, clearly I was not afforded that courtesy even though I have paid all the agreed fee to Boysan Boyra. Naturally I am very disapppointed.



Please support K5 on Sept 21st by attending the fund raising evening at the Green Palace. All the details are in message 1. Those having to fight the eviction writs really need all the support you so generously give. My villa is already taken although I will never acknowledge Akifnans Bank are the legal owners.

My understanding was that there was no court appearance it was a procedure that had to be followed, we did not have to appear. We have to go to court next week to face an eviction case, we are under enough stress as it is without all of this.

Bob, we are all stressed so perhaps avoiding situations like this in the future would help us all.
