So, what? you might well say..

Well IF the Portsmouth Publican is told she CAN view any EU basd sat tv package - then we can certainly watch SKY in Cyprus..

*I* think that if a private person does this this are NOT breaking the law - as SKY's Ts and Cs are not legal .. BUT.. this Publican is showing a Greek feed - to get around SKY's vastly more expensive public viewing rights rate.. and the European Courts of Justice have listened to arguments from the Premier League, FIFA , the IOC ( Intl Olympic committee ) as THEY sell rights by Country.. not EU wide..

This is really going to put the cat amongst the pigeons as far as Sat TV service in the EU goes. There are now companies around the EU that have signed contracts with content owners, be it the premier league or media companies, that grant them rights to distribute that content only in specific areas of the EU that are in breach of EU laws. Interesting times ahead.

Is there room for an appeal ? If there is I would think the premier league will be pursuing that.

I see that you have 'woken up' [ msg 3] - but - as ever - failed to pay attention in previous discussions on this topic..

OSN is NOT an EU based broadcaster - so NO ... the situation re OSN being dodgy in CY remains the same...

OSN is not an EU company nor is it providing service in EU areas, thus it is not affected by this ruling. It still has signed agreements with content owners that limit where it can provide this content that do not include Cyprus and thus if and when it becomes aware that a given user is outside the are it has rights for it will still be obliged to terminate that service. This ruling makes no difference to that at all.

Where it does make a difference is say if Sky becomes aware someone is using their service outside the UK and Ireland but in the EU, they almost certainly now will not be able to terminate that service simply for this reason. As to if the TRNC is considered in or out of the EU in this regard is unclear.

re msg 9 Kibris

In the short-term very little difference.. but long term... there may be a huge cut in the number of companies offering PL footie and and in the medium to long term a price war from European companies.....

This may also mean that the PL and clubs are going to lose a LOT of income stream.. As it stands now a Pub doesn't HAVE to take SKY, any more..

As ErolZ says, there might be an appeal and the UK Courts now have to decide how to implement these ECJ judgement

... 'interesting times'

Msg 15 just for info I currently watch sky content online without the need for a dish at all using the sky go service and a VPN and have been for some time. Not all content is available but 90%+ is. It has live streaming of all channels subscribed to, and streaming and download options of most other content. You can pay for it monthly online without the need for any sat equipment. Before this ruling using it here was in breach of Sky's terms and conditions for such use and they actively blocked non UK / Ireland net addresses thus requiring a VPN to bypass these blocks. After this ruling it seems likely to me that they will no longer be able to make its use outside of UK / Ireland but inside the EU a breach of the terms and conditions and will not be able to bleock EU IP addresses.

Hi ErolZ

For users with a 'rump' RoC IP then watching SKY GO shouldn't be an issue....

Sadly, the 'TRNC' uses Turkish ones.. as you say these would exclude users in 'TRNC'

Hopefully, your ISP can 'get around' that ...

As I see it if this stands ultimately content owners, be it permier league or universal studios, will no longer be able sell rights on specific EU country basis but will have to negotiate rights with TV providers based on an EU wide license. Clearly the content owners will be seeking to gain as much revenue from these EU wide licenses as they currently get from selling country based ones but it remains to be seen if they will be able to manage that. At the moment for say the premier league, they charge much more for the exclusive rights to show it in UK than say the do in Germany. How they will sell it in the future is unlcear. Will they sell exlusive rights to one provider for the whole of the EU ?

Msg 22 - the restrictions on sky go viewing compared to using a dish are fairly mininmal, certainly you end up with much more than a 'little bit'. 'Most' would be a more accurate description imo but yes it is true that not everything that you can get with a dish you can get online. For the current list of what you do not get online with sky go you can see here.

http://www.sky.com/mysky/mytv/skygo/blackout-messaging/index.html

Everything else you can get, based on what type of subscription you have of course.

It is horses for courses really. Internet based provision instead of a dish will not be right for everyone. However for some it make sense. Net based provision becomes even more compelling if you can 'share' an account with a dish subscriber that does not use the online service themselves.

Key thing seems to be the viewer needs the consent of the broadcast provider. This presumably equates to a legitmate paid subscription. So no dodgy cards..............!

With skygo you could record but it would require the right 'software' on your PC to be able to do it and its a bit of a faff. Ultimately you can record anything you can see on a PC screen but it does require setting up and specific software and knowing what you are doing.

Sky GO does not support 3D content, but for me that is not an issue as I do not have a 3D display anyway nor am I likely to rush out to get one either. All seesm pretty gimmicky tome tbh.

In theory if your net connection was fast enough to allow 2 simultaneous streams from sky go you could watch one thing whilst recording another but you would probably need two displays or be willing to watch in a window. Ultimately it my not be necessary as most content is available on demand. Most of what I watch via sky go is 'on demand' rahter than 'live'. In fact about the only thing I ever watch live at all is 'F1'. Pretty much everythihng else I wqatch on demand, from sky, bbc, channel 4 or elsewhere.

That IS interesting... so it can be 'argued ' that you should not be geo blocked

I am hearing that the UK could take up to a year to adjust it's laws - but I think it HIGHLY inlikely there'll be any more attempted prosecutions

re 22

a 'zero'

Even some ( it's most, actually) of it is a LOT more than any other English lang TV offerings.. but I wouldn't expect you to have researched that before 'commenting' !!

If your recent 'legal expertise' - ( Dale Farm and EU TV rights ) is anything to go by, thing a little light reading BEFORE posting might save any embarrassment ;)

The real cost is to the clubs Wolves Spurs £37 3pm Saturday kick off for a seat

Or £7.40 for the 3 pints to watch the match in a pub next to the ground .

Normally these 3 pm matches are not for live viewing but they are now

Sunderland are moaning that the stadium of light is not selling out as people are going to the pub to watch

Because of the recession Hartlepool's gates fell to below 3000 season ticket prices have been dropped to £100 £50 for kids

The gates are back up and they have an atmosphere in the ground and they are selling merchandise food and drink etc

There is a tipping point in any market and the premier league and football is to dear

This TV ruling will accelerate change does a basic premier league player deserve £1m a year I think not

Nicola, re 34

If you'd asked the question - "do I still need a 4.2m to get BBC / ITV?" then the answer is.. YES.. !

HOWEVER,

1) You asked "does this mean that one can get sky and will not need the huge 4.2m dish to get all channels."

2) BBC / ITV are free - you don't NEED to pay any subscription to get them .

Even if you have a 4.2m there are some channels you can't get.. e.g. stuff broadcast from Eurobird or Vertically polarised stuff from Astra 2D

The channels that ARE available change as stuff get moved about - last month Cyprus lost the BBC interactive service and BBC News 24 to 1.8m, but those channels were replaced with more channels available to SKY paying clients..

Hope that clears this up....

Looks like there is a bit more 'analysis' on the BBC link now

http://www.bbc.co.uk/news/business-15162241

It would seem that live transmission of games are not protected by copyright laws, which implies that things like movies which are could still be sold and restricted on a per country basis within the EU.

THen again further on the article says

"However, the court decision could have a significant repercussions for other rights holders outside of sport, with life potentially getting more difficult for the film industry, which also sells its product on an country-by-country basis."

So who knows ?

Will content owners of copyrighted works like movies still be allowed to sell such content on a country by country basis within the EU and providers limit access on that basis following this ruling or not ? Seems like no one really knows.

Mark 6m, is wanted by David Cameron to fill in the position vacated by the entirely innocent and lovely person Andy Coulson not that he in any way resembles Coulson just answering Q's or not, is a hard act only those suit wearers in Government have mastered... I am (personaly) not interesting in what breaks the law but in what providers like sky and others will be able to put in their terms and conditions for use for the sat service and thier online services.

Currently it is in the terms of service for such things that they not be used outside a specific geographical area within the EU. Will they have to remove such terms and conditions in light of this ruling and remove the means of enforcment, like disconnection of sat based service if they dsicover it is being used outside UK/Ireland and IP blocking for the online service ?

The conected issue to this is will content owners be able to sell content to providers like sky based on geographical limits within the EU any more for non copyright material like live football or copyrighted material like movies? This connects to the question above in that it is these contracts that providers like sky say is the reason why terms and conditions limit service based on geo location within EU.

An m,

in msg 32 nicola asked ,mmmmmm, does this mean that one can get sky and will not need the huge 4.2m dish to get 'all' channels.

Do you understand the word ALL ALL ALL ? why was your reply to her this rubbish, and again lies.

Hi Nicola

you don' t NEED a 4.2m , now. Utter Tosh (SHE SAID ALL)

That's needed to get BBC and ITV stuff , she said ALL ALL, all means all channels in any ones lanuage and in this Question , why did you then try to twist it and make it look like she had asked the question wrong, i suggest you read messages 32,33,34,and your own 35, then go and look what ALL ALL ALL means , you Obnoxious person .

Does above look familiar !

re msg 54 ErolZ

I think Sky will 'wing' their way through the next two years and the PL will concentrate on the Pubs (STILL )'needing permission' to use non Sky services.

Once again, it is perfectly clear that private users taking their SKY box within the EU are within their rights.. according to this ruling.

a zero

just noticed your latest 'attempt' at a troll post..

A good, well installed, 1.8m gets you the vast majority of SKY's pay tv services in 'TRNC' - that is a lot more channels than other offerings and it's from most folks on here's home countries...

THAT has been the case for some time.. except that following the removal of some BBC services there now more SKY pay channels, instead ..

re 59 a zero

Yes I read msg 55 and considered it to be 'trolling' and unworthy of response - a bit like "the organ grinders monkey"

m's can you tell us in laymans terms if the 4.2m dish will still be adequate now that sky is reducing its coverage on a new satellite? Here in Portugal there is talk of a 1.8m dish being required instead of 1.4m!

Hi Nicola

Sky have not reduced any coverage..nor have the BBC - they simply swapped transponders on different Astra satellites that a SKY dish receives from.. this made NO difference in the UK, but the BBC move means that 1.8m users in CY lost BBC stuff, ( now need a 4.2m to get the red button services / BBC News 24) but they got replaced by more SKY pay tv stuff.

There are FOUR different satellites that broadcast stuff we catch with one dish... some of those satellites have bigger footprints to allow reception in Cyprus..and others are weaker ( smaller footprints) and this often means we can't catch those channels - or you need a BIG ( 4.2m) dish

What you 'need' is specific to your location / requirement ... ( if you want BBC / ITV)

A local dish installer in Portugal can advise you better than I - unless you want to send me your co-ords by email....
