Hi

After a long battle last year with the Committee we finally got a vote on which maintenance co. to use. This year the committee have changed it to a company that nobody has heard of and the committee will not reply to any e-mails that I have sent asking for a Registration No. We are being told to pay our money into a bank account that is registered in GB.

The question is have they a legal right to change maintenance companies that the owners voted in without another vote from the owners?

1st question is did 51% or more of the owners vote to have the new maintenance company?

Last year we all got a vote after fighting for it. I don't know how many actually voted but we all got the chance to vote and it went with the majority. This year we did not get a vote. The committee decided to go with this company that nobody has heard of.

As I understand it it has to be the majority that own on the site that have voted for the change, note the majority of votes that came in.



You need to find out what the percentage of owners voted for.

Is it legal for the committee to decide which maintenance company to use without consulting with the owners which is what has happened this year.

No but they do, some think they are a law unto themselves, Brend if you are on Bufavento can you tell me why FCC were booted off of there, i understand they were booted off of there once before,

That is the whole problem. As far as I am aware most owners are happy with FCC but the committee have Decided to give it to a company that has tendered 50% below any other company. Nobody has heard of this company and they won"t provide their registration No. The owners have NOT kicked FCC off the site. We have not been given a vote!!!

They were not kicked off last time they decided not to tender again. Everyone was happy with FCC. In fact the committee at the time almost begged them to take it on again.

its seems obvious that this company IS the committee, and the UK bank account proves that it is not a registered company here, im sure Ismet knows all about this one...i think ?

Correct me if i am wrong but i thought the government here dont allow maintenance payments to an account in the uk as they think its a way of avoiding tax.

That is one of my concerns. If the owners are not to be trusted with the truth then how on earth can the owners trust the committee.

What the Committee can and cannot do is dependent on what is written in your the Constitution.

Have a look at it and see where you stand.

The other question would be who voted in the committee? Again my understanding is that the majority of owners have to vote in a committee that has any say in changing things.



You can have a committee that has ideas and gets tenders etc then puts things to the vote, but nothing can be changed without the majority of the owners agreement. 51% is the majority.

it's a way of avoiding tax" Can you remember where you got this information from? I am asking because the majority of owners on our complex pay into a UK bank account.

From what i believe, money should be paid into a TC bank and be able to tie up with the accounts and they should be done monthly by a TC accountant, some company's make it easy for people to pay into UK accounts but the money must then be transferred to a TRNC account, usually a lot of the banks have a facility for doing this.

Trouble is that if you dont know and trust the people asking you to pay simple DONT pay

Sorry to keep bringing this up I have now e-mailed the committee 3 times over the last 3/4 days asking for a registration no. for Blue Rain trading and have not received one reply. This morning I asked for anyone on the committee to reply, without success. IF the committee have set up the company without telling the owners (and I do say IF because I don't know if that is the case) is that classed as fraud or is there no such thing in TRNC?
