Yesterday Judge Talat Usar heard one case - Judge Ikler Sertbay the other. The message the same.



The Advocate acting for Nurrettin Tutuska said their is no solution, the whole lot will have to be sold to pay off the 6/7 memorandums already on Baris apartments all taken out after the purchasers had paid for their homes, this serial offender who already conned them all into paying between £10,000 and £15.000 to get the permissions he had 'forgotten' to get to stop the Beledyesi demolishing the apartments, so in addtion to the original purchase price they were all blackmailed into paying extra and now, barring a miracle (the govt waking up), they stand to lose them anyway. There were 6 apartments but he sold 8 (double selling) 8 into 6 does not go.



YOu wil all remember the Auction on 13th June 2010 when no bids were received. If you wondered what has happened since, this is it.

Thanks for the update misunderstood. Sad, sad, sad. I remember well how distressed one particular lady was at the auction. So distressed she was physically sick poor thing. Terrible!

To go into two separate courts, with two differents Judges singing from the same hymn sheet. What chance has ANY victim in the TRNC??



These are Turkish Cypriot and Turkish victims, at least they are equal opportunity thieves here, no racism, just after your money regardless of race, colour or creed. Consequences for the thieves - NONE.

When is the TRNC Government going to intervene and change the existing laws to help protect buyers? There have been several cases over the last decade and many more are lined up and waiting. All follow the same theme. Buyer pays in full but the builder does not transfer title deeds. Then the builder runs up debts and the bank goes after his assets which unfortunately include the house you have fully paid for.



Not surprisingly all other assets have been transferred into other family names so your property is the only asset the bank can recover from. This is nothing but blatant fraud and how a Government and the legal profession can sit back and witness several people stitched up in this way is beyond believe.



The country demands recognition. Well they are getting it. Recognition as one of the most fraudulent countries in the world when it comes to buying property and one that ignores all human rights. Are they aiming to get a reputation on a par with Nigeria?

I don't think it is apathy or mass complacency, I genuinely think that most people are really worried about the way things are going in this country and this appalling situation is another nail in the coffin. I also think that we can all give instances of prejudice, fraud or injustice and it's just the scale of the "crime" that varies.

My heart goes out to the victims of this latest case.

If you had been with me at the courts to listen to two different Judges, who lets face it, would have to be very brave to buck the system, and say to hell with the law, this is just not right. You can see in their faces they do not like the decisions they have to give down, but they still give them.



The Human Rights of anyone who has had their home used without their consent or knowldege (until too late)

as security for someone else's borowing, whether from a Bank or a private individual, have been violated. This should take precedent over all local laws. Laws that HURT innocent people are bad laws, but still here in the TRNC they remain on the statute books. Why, because they benefit the fat cats.



That creep Tutuska sat behind me in the court and every fibre of my being wanted to 'punch his lights out' and when his Advocate admitted there was NO fault to be attached to the purchasers but the apt. block would have to be sold as there was no solution, I felt physically sick.

Who knows, it will be second one, the first was held on 13th June 2010, one week after Kulaksiz 5 and we all know how that ended, especially me. by the 30th July 2010 they had taken my villa by force.

Its as much use protesting as it would have been to protest about corruption in front of Chicago City Hall ,during the Capone era.

There are probably many hundreds of people in this very same position, but until they get a knock on the door from a bank employee they have absolutely no idea. Double selling is common, we have five properties close to us - the builder has got the money twice, first time from a Brit and the second time from a TC. You can guess who is living in the properties can't you. Law in the TRNC, what bloody law? If you are a foreigner, there is none.

You are right Tango1. There are whole housing estates where none of the owners have their deeds. Some worry but feel helpless to do anything. Not surprising because what can you actually do? The law is not on your side. Many therefore have decided to live for today and start worrying when the knock on the door arrives. To hear of others is not comforting when you admit it could so easily be you next.



Others have the ability to deny there is a problem, accepting the developers constant excuses as to why he cannot transfer. Then there are those and I suspect they fall into the majority, that just don't want to rock the boat. It might turn the developer against them and that really could be damaging.They are guests in this country and therefore have to accept that this happens. It is the Cypriot way.



Dismissal, dismissal, dismissal.



People forget there is strength in numbers and to improve things, people must become involved. Not just for the property victims but

A little sad story. I had a new kitchen fitted at my K5 villa including a granite worktop (not cheap). When we had to leave for my health, we left it. When it was obvious the auction would take place, Agile wanted to smash it and I wouldn't let him. Another of my many regrets.



I just know that anyone who lives there will not find a moments happiness, whatever happens to them they deserve.

Yes, it is the weekend retreat for the Kader family (Akfinans Bank owning family) 5 CCTV cameras on it and police called if my car is seen turning into Demokrasi Sokak (the street it is in).



I think I will have to walk there when the corchidactus blooms on the 30th Oct.



I wish it would fall down now, it will eventually as the foundations are crap.



Every property is now registered in the name of Akfinans Bank Limited and according to Judge Talat Usar in the case he heard for eviction allegedly, the owners are squatters.
