| Ed1957 because the ECHR is a body of the Council of Europe which is a totaly different entity to the EU, and pre dates the EU by many years and Turkey is a member of the Council of Europe and has been since 1949. In precedents set in previous cases involving the TRNC, it has been determined by the ECHR that Turkey is the responsible party for human rights breaches comitted by the TRNC. Thus any action by TRNC that is against the ECHR charters can be and is challengable in the ECHR and there have actualy been quite a few such cases historically. If and when the current laws in the TRNC on 'unatural acts' are challenged in the ECHR, they will be determined to be against the charters and Turkey will be required to make the TRNC change said laws. Just as they were challenged in the RoC via the same route and changed as a result of such a challenge. |
