| I have been asked by the solicitor for receipts for this Tax paid to the Council in relationship to recieving a parcelised Kochan for our site. What Tax is this? How much is it annually? When does it get paid? Who has to pay it - is it me? I know nothing of this and how would I have been informed to pay it? What if I don't pay it - what ever it is and or costs? Has anyone paid it? Is this another 'Stealth Tax'? |

| Yes you do, it's a sort of property occupancy tax and they decided some time ago that those waiting for the kocan were liable for it, rather than the current kocan owner as they are not the occupiers. |

| Emlak vergisi Definition: A tax levied on real property based on its use and its assessed value. I think this is the annual tax If you own a property, ours is I think 230TL a year, it does vary not sure why |

| The point is until you have the kocan you don't technically 'own' the house but they decided that the levy should be on the occupier not the kocan holder.... |

| Hi Again, So if I get a kochan the Tax becomes payable from that year or do I have to pay for past years? With that in mind everyone is liable to pay the Tax if it's for occcupancy fot the years you've stayed in your present home. There must be a lot of money owed to the Government in back taxes? My builder and the land owner have done a deal - the builder builds houses for the land owner instead of payment for the land - who pays the Tax on the unoccupied ''builders'' house? In our case this is holding up parcelisation. |

| Emlak Vergisi is property tax and for some years now has been levied at the rate of 1TL per square metre (covered areas only) or 1.25TL per square metre if you have a pool. I notice from your profile that you live in Alsancak and I believe that Alsancak Belediye will expect you to pay this from the time you took up residence. Some Belediyes seem to pursue this more enthusiastically than others. Go upstairs at the Belediye offices and enquire there. Normally they invoice this tax around March each year and it can be paid in two installments. |

| We live in Esentepe and we have always paid our property tax from taking possession of keys to the property. We have lived in the property almost 6 years and still don't have our kocan, so it is the occupier that pays. The butlers wife |

| When the time comes to receive your title deed, the Lands Office will request a current receipt for the Property Tax. If you have possession of your property and have not paid to date, take a copy of your stamped Contract of Sale to your local municipality office. Bear in mind, that a penalty will be applied for every late payment. |

| Molly is correct about the Land Registry requiring up to date receipts for property tax payments. If you can't supply them, they won't do your transfer. |

| It is the owner of the Kocan who is responsible to pay but as stated in message 9 the land registry will not transfer title therefore short and curlies come to mind!. There are too many who advise in the bars no you are not responsible but oh dear it’s another reason why you do not get your Kocan. 2004 was the year when it went from kurus to lira therefore many did not pay in the past until they sold their house. My father owed from 1989 and from this date to 2003 the total was less than 5 lira and after that 25tl for one year a huge increase. Go and see the Belediyesi taking contract, passport and kocan of land/house |

| Another question. Why pay the annual tax when it is possibly some buyers will never get their deeds ? In a nutshell you may never be an owner so why pay ? |

| I suppose it’s the name on the kocan any threatened legal action on non payment is taken against unless something is in your contract stating you are responsible on occupancy. so i agree why pay especially if there is no chance of getting a kocan in your name. Contracts used to be able to be sold without this tax being paid. and without seeing a contract surely the tax is only on land unless its an existing house with a kocan |

| Thank you all for replying, I am not going to pay any tax for the time being as I may never get the Kochan as has been stated. Why do these things take so long to sort out? Even though the builder has said he'll hand over Kochans in the New Year I wonder what one he means? |
