For the more legal minded my question is are there more than one type of power of attorney the advocate needs to pursue a claim via the courts. My solicitor was given power of attorney a couple of years ago at a cost of aprox £350 which was sent from England on his paperwork and now he is asking for a repeat saying the earlier one does not give him the power he needs ?????????

I cannot answer your specific question about the extent of your original POA but I can tell you that a friend of mine recently had to provide a POA (document prepared by Advocate then signed by Noter in Girne) and it cost 20TL. So it sounds like your advocate is taking the pee to say the least.

I suspect the previous POA was given for a specific task, ie buying a property, getting divorced, etc. I do not think it would have covered him to do anything and everything on your behalf.

The easiest thing to do is to draft the document yourself, and take it to the London representative of TRNC, they will validate it for £25.00. I have done this on 2 occasions recently. the only snag is that it needs to be in turkish

Are you refering to the Turkish Embassy as it was they who charged the £350 last time although it was in English as is the document authorizing in detail that has been posted on to England to my daughter for validation this time .

I was told by our attorney, to get a friend to have POA as he couldn't do it for our litigation case. I had it prepared by a Girne Notary, for 50TL a friend kindly volunteered his service to accept POA on our behalf.

I am currently persuing a claim in the TRNC court against a property developer, the advocate was instructed when I was there in the summer. He has since sent me a pre written (in turkish) POA auhtorising my uncle to sign any documents on my behalf, but only in reference to this claim.

This document, signed by me, was witnessed by the TRNC representative in London whereby an official stamp was put on my document, this then became an official POA for the cost of £25.00, obviously the cost of the court case is seperate to this.

This is the same as would be done by a Noter's in TRNC, if I were there.
