'Buy pre 1974 Turkish Title Deed property - be completely safe!' stated the TRNC estate agents' websites. Our chosen agent, proclaiming his honesty, 'promised' the same: 'Your PTP application is a mere formality, and you'll have your Kocan within a couple of years.'

So, in 2005 we bought.

In 2007 we found that we'd been refused PTP as we were 'too close to military land.'

'Buy another house not near army!' we were told by the man who showed us the file containing our refusal.

We decided to pay our Stamp Duty, only to discover that an injunction had been put on our property in October 2007. We knew, prior to our purchase, the house was mortgaged by the Vendor, but this mortgage had been repaid to the bank in full and discharged. Very strange - we thought. Subsequently, we discovered that the crooked bank manager had forged our Vendor's signature and re-mortgaged our property and obviously got the bank's money ' a bit muddled up with his own'! But that's not fraud in the TRNC!

Hi, who put the injunction on? Is the land owner taking legal action against the bank manager? Which bank is involved? Have you spoken to the bank? Are they investigating? These are all things that you need to find out.

Could you tell me where your property actually is?

IS it close to any military sites?

I just get the impression that the military are used as the default stock excusewhen it comes to pursuing any delay/refusal of PTP.

I know someone in exactly the same situation. Having to go through lawyers in an attempt to get the mortgage sorted. Appears that bank managers defrauding people isn't a crime or police matter in NC!

Because you have to pay stamp duty in order to ratify your contract especially if you need to use that contract for applying for residency (for example), or going to court. It is a legal requirement.

we didn't when we came here. we used the sales contract for residency.

applied for ptp, was granted it and then paid all taxes.

has this changed this year? since april?

Hi FS, yes it changed around about that time. Now if you have to do anything where they need to see your sales contract it has to be the original stamped version and that includes renewing your residency.

I don't think it was a scam post & as I said I know someone in the exact same position anyway. The payment of tax was the .5% payable on registration of sales contracts which now has to be done within 21 days of signing. If you remember there was an amnesty at the beginning of the year for all those who hadn't registered (because no one bothered as it gave no protection at the time). When people then registered their contracts that was when they found these mortgages.
