Does anyone know a magic solution to getting compensation from Sante-Fe?.It's more the principal of the whole thing than the money itself.It's the only thig that's kept me going when I'm worrying about our apartment.

Scooby, I am in a simular situation and some advice I was given is forget about any money compensation but there is always a deal to be done for some extra work ie air con or internal fixings.



You could poss knock the amount off the final payment.

No chance. I don't see why they put it in the contract.



I think it's just so the Brits feel safe about signing a contract in the first place as though they were buying safely like in the UK.

Scooby and other members, The attitude of no chance of getting compensation is Negative and and not acceptable!



I am in the current position of handover and the developer is 8 months late in delivery!



A contract is a contract, it works two ways, the Lawyers, the legal system and the developers set the legal contract which should be binding in all categories.

WE that is the Customer/Purchaser also abides and adheres to the contract, so why should We not be compensated for late delivery as per contract?



The fact Ive had no official apology from the developer, no deductions from the final figure for late delivery makes me angry.



AND Now a threat of an additional penalty if I dont pay by Monday 5th Jan 2009!



3 Years Ive waited and they conduct their business like you are buying a loaf of bread and whats your problem!

I would say looking at your case it would be a cert for you to win your case in court after you have paid about 2,000 in costs. Believe you me it is not negative its just a waste of time going through with it eventhough the contract has been broken by the developer. Why have you lost because you are English!!

Thanks Steve,you and lots of others have been really helpful. Our apartment is in Karsiyaka on the Citrus Gardens site. I believe that Rob from Merryweathers Overseas has an apartment at the Olive Grove site.We have been told your site is complete,is this true?. We haven't had ours snagged yet because it's not finished yet.
