Sunday 10am. Auction to be held somewhere near the Abbey.



Would you like to purchase a big plot of land for just 800,000 pounds at the auction (you can have 3 families who paid the full purchase thrown in) one couple being 70 years old and having lived there for nearly 20 years...they will be easy to throw out! And another 6 couples who paid the full purchase price but had to return to the UK after learning the landowner/seller was a professional liar in not informing any of the purchasers about the debt he had to the builder and in not paying Kibtek and thus being cut off 2 years ago. OR would you like to attend the auction and support those people that paid the full asking price and which the Government are not helping one bit.

Could someone publish page 4 please?



There are around 10 purchasers, including ourselves, (British and Turkish Cypriots) facing eviction from our homes if tomorrow's auction is allowed to proceed!



One adovate (Munir Akil), based in Girne conducted most of the sales contacts, including our own (two other lawyers were also involved in selling/drawing up contracts).



Munir Akil was 'introduced' by the builder to the purchasers, and both were totally convincing in their reassurances, not just to ourselves but to also to other buyers, in confirming that the properties were free of all encumbrances.



One purchaser has an original letter from Munir Akil stating: 'I hereby confirm from the searches carried out that there are no encumbrances, registered charges, mortgages, injunctions, interim orders, or any other charges or impediments over the property”.



I have permission from the purchaser to put on this website but I don't know how to do it?

This is disgraceful but I fear that this could happen more and more even to us, as Medview have taken a mortgage out on our properties at Esentepe. The best thing to do is not to bid at this auction, if no one bids then none of the properties will be sold. Can anyone post what is being said in the Kibris Star about this please. As this paper is owned by Mr Ali Safa who also owns Medview Homes. Who have taken the mortgage out on our properties.

Sorry part 2:



Our opinion is that this letter combined with yesterday's Girne District Court decision could be interpreted as bringing the whole of the TRNC legal system into disrepute?!



There are many other developments where 'innocent' purchasers are caught in the middle of disputes e.g. landowner has mortgaged the land without purchasers' agreement etc.



The HBPG are fully aware/involved/supprting our situation and please show your support by getting to the Bellapais Cafe before 10.00 am tomorrow.



Collectively we must prevent this development going auction tomorrow.

I wish we could sue the lawyers.....my purchasing lawyer did not even do a search and now after reading your post I can see that even if Mr Liatsos did it may have shown nothing. Also why did our litigation lawyers not suggest making an application for the auction to only include those empty villas and unsold land when they were first informed about 2 years ago I wonder.

This scandalous state of affairs makes me seriously question whether I want to maintain a holiday home in a country which shamelessly turns a blind eye to this level of corrupt practice.



If the TRNC wants to gain favourable recognition around the world , then this is certainly NOT the way to go about it.



They deserve all the bad press,and the subsequent economic consequences that this will bring.

The guy that is responsible for this situation is an absolute weasel. He has taken people's money and in some cases, delivered nothing - just a pure con-artist.



I know Mustafa and family (one of the affected purchasers) and you couldn't meet a nicer, more trusting person. His family have lost everything to this w----r and (quite rightly) he feels terrible.



There is a lot of dribble on this forum but in this instance, there is a chance for the forum to prove its worth:



Please show support to the affected families by attending the auction and attempting to persuade anyone who is thinking of bidding, from doing so.



Pure numbers may be enough to achieve the desired outcome.



Can someone please post directions to the location of the auction.

My advice is to turn up at the auction with a few AK's and fire off a few rounds into the air causing confusion and postponement of 'Sales Day'! That should cause a couple of heads to turn and hopefully an international incident! All a bunch of crooks and better off dealing with the likes of the 'Krays'!

The cafe is next to the Bellapais Monsastry. Please, please attend and support these families facing eviction. There are hundreds of people who could be in the same situation in the future due to mortgages taken out on sold land/properties. A show of support and strength is needed.



The owners have the moral high ground here. They've paid in full for their properties and taken possession. I hope the government will intervene and take action!

What a terrible situation these people find themselves in and through no fault of their own. Yet this situation is by no means an isolated case. For several years those of us that have regularly followed and taken an interest in the problems associated with buying in the TRNC know full well that it is fraught with problems and that purchasers have little to no protection when things go wrong.



There are dozens of people that post regularly on this forum that have paid all monies in full and are still not the legal owners of their properties due to not having been granted PTP or not having received their title deeds. Many more have developers who have taken mortgages on their properties. Even more have been waiting for many years for their property to be completed.

Yet when newcomers to the forum announce their plans to purchase, a picture of paradise is often painted and anyone who raises any negativity is immediately shot down. It no longer matters if you have a good builder or advocate anymore, it is the system that lets you down. There is simply not enough legal protection or government willpower to promote a system that safeguards buyers against corruption and property scams.



This situation will continue, until people stop purchasing and the message is given that people will not tolerate a system that actively encourages corruption and takes no action against the perpetrators. The tables needs turning and people need to realise it is no longer sensible to invest in the TRNC when so much could be lost.



When people no longer invest in the housing market the government will then have to remedy the situation to encourage investors. Sadly they do not have appeared to reach this stage yet.

I have only just read this, my heart goes out to those involved.



I wish I was out there, but sadly not.



It's obviously too late to take any legal action to stop the auction.



The only recourse may be concerted disruption of the auction with as much independant press coverage as possible.



My suggestion would be that when the auctioneer offers lot XX at an opening offer of XXXtl, someone stands up and offers 1tl.

Then someone stand up and offer £2.50, someone else 3 Euros, then 2tl, then £1.25 etc, etc.



If this is done fast enough, the auctioneer will be unable to accept 'real' offers for the lot and may even request police presence to remove disruptive bidders.



I know this sounds a bit silly, but I have personally known this approach disrupt dubious auctions in the UK.



Press presence is critical. With enough cameras & videos running, most such auctions will be stopped.



Please, please, anyone who is capable of disrupting the auction, do it!

Disruption of the auction with press coverage is possibly now the only hope.



It could be an idea for any heckler to offer '2 Million Lire' for any lot,.. then to say they were offering 2 Million 'Old' Lire, just to cause confusion.

We all thought that the Property Information Office, TRNC government, TRNC London Representatives Office, Girne District Court etc would stop the auction or only allow the auction to sell the unsold villas/plots which should be sufficient to pay the £450,000 not the sold ones as well!!

I like the idea of disrupting the auction so it cannot operate effectively - Plenty of press - Give them a good briefing so that they come in their Droves - emails Sky news - get some publicity in England.

If I had been in Cyprus I would have come too. I would have been in Cyprus if my builder Cafer Yugelgazi had not declared that he has gone broke.

GET PUBLICITY - GET SKY NEWS - CONTACT MPs - CONTACT BBC, CONTACT ITN, CONTACT The Mail on Sunday - the put the Oram's case in the paper and outlined the problems.

I assumed you had read the links to this story from papers

Hasan Tocan Mesutoglu is the land owner and he lives in one of the Sun Villas on the site in Catalkoy, some of the residents claim he has assets elsewhere and has placed properties in his wife and daughters names so as to be safe from being sold to raise the 450.000 pounds he owed the builder.

This is a terrible disgrace,and its about time that someone sued the TRNC Gov..the Builders,and the Auctioners.how can they auction anything that is not belonging to the said sellers in the first instance..Sue the buggers for not doing their job...its like someone taking your car,or furniture and giving it to them to sell....(not quite but get the gist,)

In England or the USA this would happen..someone please get to the court office and lodge something ASP..

i know i sure as hell would have been stright down to the courtrooms if this were to happen to me..

You have missed the point. These families have already exhausted the legal system and it is the court that has finally agreed that the houses be sold to pay the debt. This is the legal redress authorised by the court in Girne.



This action will continue to happen with purchasers who are unable to get their deeds.Whilst ever the builder has the deeds he remains the true owner and it is this that puts your house ownership at risk.

Wild olive, read letter from Munir Akil, regarding morgages etc, dated 2004. Wonder what date the charge was levied on the land, it may have been free of charges when letter was written. When did charge come to light , was it when they registered their Sales Contracts. Hopefully this new process has stopped this nightmare happening to those who have registered.

Hopefully the auction is posponed or disrupted today.

Mustafa and all the other affected parties and his supporters won out the day.



Maybe 120 people attended and 'the auction' and whilst a few 'bidders' were present, Mustafa did a brilliant job of canvassing them (asking them not to bid)



There were a few heated exchanges whils plain clothed police looked on.



Three announcements were made at 10am, 11am, and 12 noon - there were a few leeches hanging on at the perimeter but none of them came forward to place a bid.



The media were well represented and it was quite funny to watch one table of potential bidders 'scarper' when the TV cameras turned up.



Well done to all that turned up and showed support, but next time there needs to be more.



Apparently, the auction will be held again in 3 months time, but watch this space. Who knows what might happen or, what the next twist or, turn might be.

It's heartwarming to know that there are still people willing to go out on a limb and support others. While this is obviously still in the balance it is an excellent result for today and a welcome if somewhat temporary releif for those involved.

My only worry is that as with many auctions,any "interested parties" can just approach the auctioneers and do a deal outside of the auction....without the furore and negative publicity generated today.

More seriously, I don't think that private bids can be made.



What I was amazed by is that, on this development, it seems that there are enough unsold, empty houses to cover the cost of the outstanding debt. Why on earth these were just not auctioned separately is beyond me, but hey, this is North Cyprus.

Comments have been made that some of us are in the UK - Well that does not stop us doing something.



I have sent articles on the protests to the Mail on Sunday, Daily Mail and The Sun.

Come on - follow this up. Bombard them with stories, incidents, facts get as much publicity as you can in the UK - This will stop other fools falling into the trap we have just landed ourselves in in TRNC with builders, advocates etc.

Someone commented on many of us not being in TRNC, but the Uk. Well that does not stop any of us from taking action (I just could not attend)

I have this morning copied articles from the web and sent them to the Daily Mail, Mail on Sunday (they printed the Oram's case) and The Sun (they print anything)

Now there are lots more newpapers, so come on bombard them with stories like this one.

I would like to add some more to above after spending the morning at Bellapais.



Washerman has it right about plain clothes and no doubt all our mug shots will be displayed for when we next apply for residency.



One thing the the boss and I found was the emotion from our TC friends at the support that turned out. They probably feel just as alone as the rest of us do as we fight our own cases.



Of the potential buyers at least a couple got into a GC registered Lexus as they left, interesting or what????



Given that that most of us only found out about this yesterday am the turnout was quite good. That said the number who read CT every saturday means there were several thousand potential others who could have done what we did which was to contact HBPG and got the facts.



Having chatted with a couple of the TC owners who had spoken to the Government Minister who turned out they feel they have a little more hope that the court judgement may be dealt with accordingly.

Finally, this type of auction, like the ones to dispose of impounded cars are not openly advertised normally so it is almost impossible to mobilise "troops" to attend.

3 months notice given before the next auction. Plenty of time to mobilize. AK's, Semtex, Grenades and a Tank or two with air fire cover from a helicopter should show the corrupted administration business is meant. With all the retired ex services personnel now living here, there must be plenty of expertise to make this a reality!

Sorry to say it's gone belly up in Northern Island today, as things were settling down so well! I certainly cannot condone the actions of, which I'm sure, were just a few. Talking about AK's semtex, grenades etc. may be amusing to you but have you considered the possble ramifications? This sort of talk will fall straight into the hands of the authorities who may wish to use it as evidence of possible acts of violence, terrorism even. It would give them the perfect excuse to break up any form of gathering (including at an auction). It could even lead to deportations. Far fetched? I don't think so. Not so amusing now is it?

Hopefully fantastic news for us personally and possibly a clear signal of hope/action from the new TRNC goverment for other purchasers with problems.

Cyprus Today (Mid-week Ed) had a front page article saying that the TRNC government is 'stepping in' to help the Sun Villas' purchasers in Catalkoy and only the unsold villas/plots will be auctioned, following the unsuccessful auction on the 12th July.



I can then share it with the other Sun Villas purchasers (10 in total) based in the UK, who have been ‘worried sick’ for a long time.
