Having just spoken to my CC company they have stated that whilst they cant progress claim for a refund on CTA tickets until after the flight date what they have said is that as CTA have ceased operations and Atlasjet have currently stated that they will not be replacing the CTA fights as per ticket times then I can rebook with another airline.If Atlasjet then replace those flights it is still possible to reclaim your money under section 75 of the consumer credit act as a consequential loss rather than just a failure to provide the service



Anyone from a financial background care to comment

From what i understand you can put a claim in before you fly its called 'anticipatory breach' , you have a good chance of getting a refund from what i have read, im also waiting for my claim forms to but a claim in.

Have a look at the link below if you have problems with the credit card quite helpful.

Jada79, good link you have posted there.



You need to clarify what sort of ticket you have, who sold it to you etc, as the rules are different.



E.g. Did you buy your ticket direct from CTA or their agent? Or did you buy from a tour operator who are ATOL protected? Does your tour operator plan to provide alternatives? Have you been able to contact whoever sold you the ticket to see what they are advising?

Re msg 2 - Its a real CC



The booking was direct to CTA who have ceased operations.The fact Atlas have published in their FAQs that they currently do not intend to replace CTA flights is enough.Having now paid out for new flights on the basis of their info even if they were reinstated I would now have lost money as a conciquence and this loss can be claimed back by CC company on my behalf from CTAs bank not CTA.It matters not therefore if CTA have any money.

I was informed all I need is material to prove the facts ie FCO website info,Atlas FAQ info and an email copy sent to CTA requesting a refund.

Upon receipt of this CC company will look to recover funds which should take 5 days

Good stuff Bill. We sent an email to our CC company explaining the situation.



T'other half just had a call from them. They have looked at the website showing there was no replacement flight on the day we had booked and said no problem they will reimburse us.

As msg 2 stated, it looks like those of us (myself included) who booked using Turkish cards might be out of luck. Has anyone had any experience trying to get refunds from a card that isn't based in the UK? I know the consumer credit act or whatever it's called protects UK and US cards, but haven't heard of anyone attempting to get something back from TurkBank or any of the other ones.

In February our friends booked to come out to stay for the forth time in September .. Unfortuately Ian is to have a hip replacement operation hopefully in August, he only found this out in the last few days as to when the op is likely to take place ..

Does anyone have any suggestions of how to get any refund .. Or will it be a lost cause ..

Hi bill/vidan, which credit cards are you claiming with as I too was told to rebook new flights by Eggcard but haven't yet claimed.



Also, is it just the original flights we claim for or the replacement ones as a consequential loss

yes my friends got a refund within 24 hours of contacting the atol people from the



tour operator they purchased from they were first given the excuse "tickect provider agent" but she one not to let go after many chats with atol they were infact charter block seats the tour operator purchased in advance



and the law states the tour operator must refund on these or the atol will its the law











its that simple no need to claim from credit card and if they offer you a flight more than 12 hours either way you can still cancel and get your money back







that simple no need to go round the houses no need to stress

Yes, people need to ascertain the type of ticket they have, whether they have ATOL protection, etc. If they do, they should pursue that and not be given the run around.

Its an MBNA visa card



I have been told I can claim for the full price of the original tickets plus ANY legitimate additional loss that I have incurred.I have taken this to mean the extra 255 pounds I had to pay for my new tickets over and above the original price paid

BillBarnacle, I just rebooked tickets on Easyjet using my MBNA card after the farce with Barclaycard. Once they refund it's going through the shredder along with any idea of ever booking an atlasjet/CTA ticket. It's the cheapest from now on, even if it is via the south, something I thought I'd never do.

I have just spoken to MBNA and they indicated quite clearly that they would refund if the flight on date and time did not go ahead. They even suggested that if was not covered by Visa policy they would look at Section 75 of Consumer Credit Act because that should cover it as well. Will rebook with someoine else now to fly out later this month.

No need for cash refunds look at the other psots they are issuing new tickets for £15 admin fee on new atlasjet flights (unless you are talking about a flight you have allready missed)

Worth remembering for goods and services over £100 always use a credit card if you can as it bestows so many consumer rights in the process...



Paying cash bestows virtually no rights.

harita msg 8. I would think the only way to get a refund would be through your friend's holiday insurance if it has been declared that a consultant was being seen. If he didn't have insurance and hadn't declared he had hospital appointments I can't see him getting a refund from a flight only booking.
