We can't get our builder to complete our villa, has anyone got any ideas how to pressure him.

The villa is now 14 months late there is only 1 weeks work left and it has been in this state for about 8/9 months.

We still owe 10% but he incures penalties every month which he says he doesn't recognise.

Take possession and arrange finishing yourself, if as you say there is only a weeks work left. If you still have 10% I imagine its at least 10k, so accept villa at present state, agreeing 90% complete and no more payments.Arrange another builder, you'll probably save money and have villa within weeks.

Hi Stingray,



If you owe him money and there is only one weeks work left to complete the Villa why won't the builder finish off the work.?



It would appear there is a hidden agenda/it maybe related to his VAT payments on completion!



I would contact your solicitor and tell him to write to your builder giving him 4 weeks to complete the work/failing that you will then get another builder in to complete and you will deduct the cost of this from the builders final payment.



With regards to the delay penalties just deduct this from your final payment through your solicitor.

It appears that Can is making an effort to complete the Paradise site at Barcheli

but does not know how to answer emails or when I phone he imediately cuts me off.This is a good sign, I think he wants to supprise us all and get the site finised in the new year.My bungalow is a week away from being finished and has been so since last April.I am confident that we will have our properties this year. sorry,just woke up........I was dreaming .

Seek advice from HBPG. Unite with any others on site as you will gain support from each other and the builder will find it hard to fob you all off.



Set deadlines, action plans with the advocate and be prepared to use another advocate if your existing one appears ineffective.HBPG should be your port of call.

I've seen some of your posts on one of the Bahceli threads. Its good all of your site are talking to each other, I'm gonna try and get others from esentepe site to join cyprus 44 so we can comunicate to.

Can hasnt' spoken to me since August 2007 and ignores text and email since he built our unique pool and surround.

When we visited Cyprus in August last year he disappeared to Turkey and we didn't see him once and this was the visit we thought we would be completing on.

Perhaps one day? now i'm dreaming lol.



Thanks Bradus we were thinking that route one day, but at the moment we speak a little to 2 others on our site but we are all still toiling on alone.



Thanks Gates for offer we will bear you in mind should we need someone.

Electric is connected but I don't know if it has been certified yet.

if the builder dose not do your snagging you can get a price from us to carry out the works and give him a dead line if he dose not do the work in the agreed time we could do all your priced snagging give you a futura witch you could then give to the builder with the remainder of your money ie you owe builder £5000 fatura comes to £1000 you give him £4000 plus the fatura easy you can call me if you want on 05338433001

I heard that he is struggling to come up with the £25k needed to install the transformers so he is getting them cheaper direct from Turkey. this takes time... hopefully when he has the transformers ready to go in you will see your villas finished quite quickly!!!

A fatura is a receipt that itemizes costs and KDV and is your only hope of any legal redress if things go wrong. One of the other things to bear in mind is that when permission to build is applied for by the builder Kibtech give a price for supplying electricity to the site unfortunately after a year plus with other sites that are starting to be built around the area things change as far as Kibtech are concerned so your builder ends up with an extra cost which obviously he does not want to accept and wants to pass on to his customers. what you all have to decide is whether you want to bite the bullet and help Can to get the situation sorted or you all take the longer route and fall out with your builder and spend another 1/2/3 years trying to get it sorted.

The choice is yours

I think your getting mixed up with the site at Bahceli, this site is Esentepe view, close to Haticafe. Kibtech have brought the power cables to the site last May or June and all the transformers were installed at the same time, for this to happen I believe 8 or 9 owners paid £1000 I know I certainly did.

I make you right there mate . We had the same problem in Bahceli. Our developer suddenly sprung on us the fact that the Government had withdrawn it's help with the electricity installation. Which meant our contribution suddenly DOUBLED. No warning, just the fact that we had to pay !!



Don't be fooled by the developers promises Ray. If they have have to pay extra ,then YOU pay extra.

All we want is to complete on our villa in a friendly civilised way painlessly as possible. We want to accept it incomplete and have even offered monies to do this, but we recieve no replies whatsoever. We want to be fair and adhere to our jointly agreed contracts but we get no answers.

We think our next move will be to join HBPG to see if they suggest anything.

Also it has been recomended that we make a formal complaint to the Property Complaints Office, but wanted some feedback on them first.

I apologize you are right and part of this posting should have been directed to Chicken Run but there is this misconception that extra costs for the electricity infrastructure should be born out by the builder when it is Kibtech that change the rules and costings after permission to build has been approved.

Anyway I hope you all enjoy your property purchases and if you ever organize a BBQ then don't forget to invite me.

A couple of things to think about for all purchasers:

If you fall out with your builder you may end up having to pay someone else for completion of your properties but the builder will feel under no obligation to transfer and parcelise the title deeds. And that is where your real problems will begin. Certainly obtain advice from the HBPG they are an excellent source of information and help. Only use your lawyers/ 'solicitors' as a last and final resort.

I remember the phone conversation but I have had no returned comunication from my solicitor or yourself since then. All my emails go unanswered and it has gotten to be very frustrating.

I have found this site to be an absolute godsend, it has put us back in touch with Cyprus which up until 2 weeks ago seemed a very long way away.

Been a while so was just wondering how things are working out Ray as it would be nice if this thread was finished on a positive or even happy note



Often when people have probs which are aired on site they forget to return and let everyone know when matters are resolved, or even updated, which I think it would be helpful and help to bring a particular thread to an end.

we visited at the the start of January and everything is nearly finished,of course there are a few small things that need finishing but i have to say that Can has built us a beautiful house,things have taken longer than we expected,but in the end i think we got what we wanted.

Thanks for the post and showing interest, I have spoken with Can and he tells me the villa is now finished.



I have made arrangements to visit Cyprus and will be there next week, untill I have had chance to inspect it I didn't think it appropriate to say anymore about it.



However when I'm there it will be with a positive attitude hoping to complete and finally cross the finishing line.



On my return I will indeed let you all know of the outcome and I'm hoping (everythings crossed) it will be of a positive and progressive climax.

I'm glad your happy with the villa Can has built for you as indeed we are happy with ours, and apart from a few snags I think there will be very few issues with it.



I don't really want to go into much detail about our problems but they mainly center around the pool, just have a look and you will see, and the time scale of a 12 month build starting July 2006 ( 30 months so far ).



Anyway please don't get me started on all that because I'm trying to stay focussed and positive only, and to open up that can wouldn't serve much purpose at this point.

watching the mighty bristol city demolish barnsley,Iain we intend to get the

eletric meter fitted in march,we got the water meter fitted in December.

Ray glad you are getting things sorted we dont know which house is yours so we dont know what problems you have with the pool we started buying ours in September 06 but we haven't been in any hurry so we've been happy to let it take as long as it has,because of this Can has taken his time but then he hasn't

hassled us for the money either.

Of course everyones situation is different so its not for us to comment on yours

anyway we look forward to meeting all of you.

Hi Ray, Paul and everyone on the site.......I'm the Clarets fan ! What problems are there with the pool ? I know from Alan(at No 2) that the pool pump housing has been shipping water in mine and one or two others.It sounds as if there may be a sealant problem,but if thats the case then Can should be able to sort it out fairly easily.I am flying out tomorrow and will be staying a the Esentepe Villa Hotel until Saturday.My mobile numbers are 00447870612621(UK) and 00905338315057(TRNC)Give me a call,if you want and we can meet for a beer and a chat.I'm going to Kibtek this week with Can to apply for my meter........so finish in sight.....I hope.Iain

Hi Graham,just come back from TRNC.Met Ray,Alan & Jen,and Can again,whilst out there.No progress up to being there it seems in the last 6 months.However,after meeting Can,have arranged for meter fitting by Kibtek,next week.Also sorted snagging issues and hopefully getting kitchen/bathrooms finished this week.....only time will tell.Spent plenty of time with Alan & Jen,and really enjoyed their company.Gaining some insight into life in Esentepe and it would appear that the road may finally be sorted soon!

I hope all is going well for you Stingray with regards to getting things completed. I noticed a quite serious point earlier in the thread and thought it might be wise to give my own advice.



I think it was Magicart and Pilgrim who both mentioned the possibility of using outstanding money to contract another builder to finish the work and then simply deduct this from the final payment. I can't stress enough how bad this advice truly is! to do so could get you embroiled in serious legal issues as it is quite simply a Breach of Contract! How would he get insurance cover on the current build? this is why builders tend not to bother with this practice to begin with.



I would stronly advise against it and suggest you discuss matters with your solicitor. Don't breach the contract because you feel that the other party have. I am amazed that people would freely offer such terrible advice like this, is this part of the reason why there are so many horror stories? too much poor advice?

I too would agree with post 67.My villa has,since my last visit,had the electric meter fitted and has power on.The pool is sorted and the kitchen nearly done.Nearly over the line now,so it can be done Ray.......just keep the faith.
