If I knew where he was he wouldn't be walking. He was originally from Yorkshire so probably hiding there somewhere. Perhaps Luke Berisford may know, between them they fleeced us.

Through Phil Shearstone we paid a deposit on a property. After a couple of months the developers properties disappeared off the website. We emailed Phil Shearstone voicing our concern to be told that all the properties had been sold and there were no problems. This was a blatant lie, as when we returned to the island some nine months later, Shearstone had left, Luke Berrisford had also left and no-one else had ever heard of us. Eventually one of the remaining staff (moved to hairdressing - no longer on the island) found some of our e.mails agreed we had in fact paid a deposit and told us this could be moved to another property the same developer had now embarked upon as he had been unable to start the first development. The developer has denied ever receiving our deposit, this is also a blatant lie as we have proof. The second development was also never started to which we were then offered a third property to which we politely declined.

this confuses me if you have paid a deposit by legitamate means to developer you will have proof if you paid a deposit by money transfer or cheque to an individual I am sorry that you have been so naive

We have proof of payment from our UK Bank and also after a lot of hassle, proof from Unwins that they had paid the builder. But as usual they have washed their hands of any wrong doing by their employees and told us to sue the builder........

I think what a lot of people forget is that Estate Agents are agents for the seller not agents for the buyer......

The problem arises when people hand money over to the estate agent rather than their advocate or builder. An estate agents job is simply to sell the property. It has never been to draw up contracts, refer buyers to advocates or play bankers.



Yet time and time again we see buyers extending the role of the estate agent and giving far to much trust to them. Other than showing you the house you want to buy, there should be no contact with them after the sale negotiation.



By involving them in the money side of things or the contract, it becomes a further unwanted tier in the process and another organisation to blame when things go wrong. It simply makes buyers confused as to who did what and who holds responsibility.



For new buyers to the forum this is a practice that should be avoided.

As far as I know the only thing agents ever have a a very small £100 max holding deposit for which a proper recipt is given.

As Bradus (13) said they are Agents only and any futher monies should be sorted by your advocate and no other person

As they say, hindsight is a wonderful thing but I am now certainly wiser and a lot poorer since 2006. What does intrigue me though is through all these threads nothing has been heard from 'Msg 1 THROSTLE' what axe do you have to grind or are you a friend of Shearstone and just finding out if it is safe for him to come out of hiding

No I'm not a friend of Phil Shearstone or even a relative, cause then I'd probably know where he is

Was interested and YES he took our deposit (on behalf of Unwins) and we STILL do not have a residence

We remember a very sympathetic, plausable person, who kept pressure on, get your deposit in or you could lose out. Sound familiar

Wish we had "lost out" now, would be a lot better off
