We have just registered our wills this morning. Used the template from the HBPG which was easy to follow.

Went down to the court in Girne and eventually were directed to the Registrar's office (ground floor second door to the right of the land office then 1st door on left) took our friends as witnesses and signed the documents in front of the registrar who then stamped them & put them into an envelope (provided by the court) and sealed with sealing wax, gave us a receipt, job done in 10 mins.

You need to take stamps with you, 32 tl for the will and 6tl for the register per person and of course you all need your passports.

Hi Jasmina, do the Court give you a copy after you and your witnesses signed and is there a registration number on the receipt? Just curious as need to make will here too.

Many thanks, Mrs Snakes

Making a will is the easy part, my husband and myself made very simple wills together, he died last year and I am still waiting for the house to be put into my name after paying £1200 sterling plus 800 tl for probate to our solicitor. The house was bought in joint names and we have had our Kocan for some time, so I really dont know what the hold up can be.

Msg 1

Thanks for the positive post as this is something we still have to do yet, definately not paying £500 to an advocate to do this when it is so easy to do yourself.

Thanks

Mike

Our lawyer charged us £100 each last year and merely plut the Wills in their safe - NOT registered at Court. I am on my way to get them back and start again, MAINLY because after we had said 'yes' to their being exector, and signing, I casually asked 'How much for being executor' and they said £1000 each. I nearly fell off my chair as the only thing we have that involves an executor is the house!

Rip off! I now know of another way of doing it, but the biggest headache is having an executor accepable in law here and one that does not charge rip off pric\es to ex pats.

Any ideas anyone.

And please, Marian, e mail me a template too!.

Registering a will is indeed very simple, as are most registrations in TRNC. A few stamps and a visit to the Court House in Girne.

Beware of advocates charging extortionate fees for simple works that most are simply ignorrent of.

It is the less informed, frightened and unadventorous ex-pats that play into the hands of advocates who often have little duty of care or accountability to clients. The system in TRNC is simply not like going to a UK solicitor.

Again beware! " seek and thoust will find"

My lawyer charges 100GBP, and I was going to get her to do it, but the mention of executor has taken my eye.

Can someone please inform me exactly who is/are qualified in TRNC to be executors?

will be following above advice to make my own new will. As our lawyer was the executor it just cost me £3000 to get probate on my late husband's will (house valued at £90,000 and small amount in bank account.) If a lawyer is executor they can charge up to 6% of estate value as fee for doing the probate. remember your cash in TRNC bank is taken in to account as well as property.

executor doesn't have to a lawyer but should be someone who is resident here, not someone in UK.

hope this info helps.

The executor of the will is, as in the UK, the person or body that oversee the instructions of the deceased.

This may be a family member or other. It is only necessary to rely upon legal assistance if there is claim, contest or other issues. Be aware as ever legal eagles will always be the first and best fed.

The Court will use the filed will as the precedent. Make sure that your will is registred in the TRNC Court and if necessary file a copy with your advocate or even UK solicitor with the TRNC reference clearly shown.

There really is no need to complicate the deed though many advocates will advise otherwise.

You can now download a free, blank "standard will" here: http://is.gd/5ILD3 (look for and then click "Wills"). More instructions on the web page.
