Would have been nice to interview me . . . . I bought in 2002 and sold last month. Tthe home was fine just did not enjoy the iron works which moved acrossed the street in 2005. Two years ago we received letters from Prime Ministers office the works were not allowed to be at this location but this year they again expanded ? ? ? With everyone having cousins in high places the island can never change. Still we loved our property as well as TRNC but not enought not to continue living with metal beaters..

I'm told the Norwegians, Russians & Swedish are buying now as they think it's cheap. I wonder if the Russians will simply roll over like the Brits when they get ripped off.

What about all the people who bought here with no problems? I hope they do a comparison with how things can go as well as how thay can go wrong.

Rufusa.............The people who bought with no problems ,have still bought a property in an unrecognised country, were the laws change at the drop of a hat.....some say they have a pre 74 Turkish title which is safe and internationally recognised...strange thing to say when the country in question is not recognised by anyone other than Turkey.and PTP's are no longer given to foreign buyers..........and yet.... They still buy like Lamb's to the slaughter...

Rufusa (mess 11) There are many victims now in the TRNC who thought there was "No Problem" lay back and forgot England, Russia, Norway and Sweden! along with many middle eastern workers, sometimes realisation takes a while to dawn on the naive!! as martinD41 says Lamb's to the Slaughter...............

martinD41 I am not trying to defend or justify that situation that exists here in the TRNC for buyers of property. I know and accept that many , far too many, people have had problems that they should never had had and there have been and continue to be systematic failures at all levels from government through to the legal system, advocates, estate gaents and builders that need exposing and highlighting and ultimately challenging and changing. However I do have to say something about this idea that nothing the TRNC does, no 'document' it issues has or can have any legal validty under international law because the TRNC itself is not reconginised. I have to comment on this because it is a widely held misconception. In general this is true but like all rules there is an exception to this, defined in international law through precedent in many historic cases. this exception is known generally as the 'Namiba exception' [cont]

Not because it applies only to 'Namibia' but because it has to have a name and the precedent was first established in realtion to an international case relating to Namibia. Since then its acceptance as part of international law has be reafirmed in many many subsequent cases. In short what the 'Namibia exception' means, is that in certain specific instances, acts and documents produced by states not internationaly recognised CAN and DO have legal validty internationaly. The 'principal' fo the 'Namibia exception' is in laymans terms, that the intnent of non recognition of a state is to punish and isolate that state NOT to punish indivduals that might happend to live there. So whilst the general rule under international law is that (recognised) states must not do anything that does or might confer legitimacy on a non recognised state, exceptions are made to this general rule. The simplest example of such an exemption would be a birth certificate [cont]

issued by a non recognised state. Under the general rule any (recognised) state that accepted the validlty of such a document would be doing something that might imply legitimacy of the state that issued it. However under the 'namibia exception' for recognised states to refuse to accept such a document as legitimate would in effect punish the indivdual concerned for something that is not their fault just because they happend to have been born and live in a non recognised state and thus under this 'exception' such documents can be and in fact must be recognised internationaly even though they have been issued by a non recognised state. Now it is not clear if title deeds issued by the TRNC for non disputed property (pre 74 TC) would be covered under this and that is not what I am saying. What I am saying is that in certain 'exceptional' cases, acts / documents by a non recognised state CAN and DO have validity under international law.

Bradus you even corrected my spelling mistake / typo of "estate gaents" to "estate agents" Though you did miss the the 'never had had' which should be 'never have had'. If only I though anyone might consider anything I wrote here 'excellent' I might even bother to spell check lol. Sorry for going off topic, its late.

I was watching Bleak House last night and could not fail to note how the courts, Dickens portrays, mirror the TRNC courts of today – how shameful.

Trncvictim. To suggest that the many people who have purchased a property here with no problems, including thousands of TC’s, are naïve, is rather ambiguous. As for titles not being recognised by the international community, who themselves ignore their own laws when convenient, the ECHR court has decided that purchasers in the TRNC DO HAVE RIGHTS. It is the courts here that cause most of the problems by standing by the villains, rather than protect the victims.

msg 26...What is the good of the ECHR deciding purchasers have rights, when the courts here,as you say, stand by the Villains .............It doesn't amount to a hill of beans...........
