I came across this article in the Daily Telegraph and subsequently found a bit more on another site.

Now I know that TRNC is not properly in the EU (yet??), nor does the article clarify if action can be taken retrospectively. However, it is interesting to see where things are going, and the inception of this scheme may well have an impact on future rulings from the Europen courts which could benefit claimants from TRNC who bring cases.

An interesting article thanks......But why on earth do you wish to be part of an ailing multicultural experiment ie; the EU?

I've read that actions are being taken retrospectively, for example, in Spain.

So it is a very good development for the property buyers in the EU countries, especially in RoC where they've been in denial for so long.

As for TRNC, honestly I can't see anything happening in this direction while the EU acquis communautaire is suspended.

I don't see how I implied that I have any affection for the EU but just to clarify my position, if TRNC ever becomes part of the EU I will wait maybe 1 year to let property prices ramp up and then I'm gone. I will never live within the EU again and I curse Ted Heath and all his works!

You never know, the TRNC government seems rather besotted with the EU (or maybe just the money they get from them) so they may take heed of this; and it does give another string to the bows of HBPG and BRS who tirelessly campaign for fairness and transparency in the property market. If retrospective action is possible it must fire a warning shot across their bows if they hope to be full members of the EU. Also, as I said, it must influence decisions from the EU courts where some (K5 for example) have taken their case.
